Hello house 

My interview was on the 13th of April 2023.

On my interview the CO asked me when last did we see each other? I told him 2019, he asked why haven't she visits me since then.. I told him due to covid and she was planning to come last year I told her not to come because of the Election coming up soon. He asked me about our chat conversation.. I gave him thousands of chats he looked at them and said he wants the ones of 2022 2023 he was going through them one by one.. later he said I should tell me my to submit a joint sponsor and she should send it directly to them through the DHL including 2022 tax return.. he gave me a white paper and tick the joint sponsor part.. at the bottom he ticked Administrative process. 

5 days after my interview my wife got the joint sponsor with all the other documents they requested and sent them to the Embassy through the DHL.. due to the holidays in Nigeria they are yet to receive the package from the DHL.. I know they must surely recieve it after the holidays.. please I want to know if I still have a good case or not

Honestly? No, I don’t think you do. You had a previous K1 denial because they didn’t believe your relationship was bona fide (=real). You have not addressed the issues - not seeing your wife for 4 years is not normal and is problematic. The reasons (Covid, election) are not valid reasons and are odd to say the least.

Did the CO keep your passport?

 

your AP will probably be a long one before u hear approved or denied?

 

Covid was 2020/  we have been able to travel since 2021 when fully vaccinated

Nigeria opened back up according to the following  April 2020

there was no Presidential election 2021 /there was only a state election to fill empty House of Assmebly empty because of a death

 

2022 and 2023 February elections were tumulutuos but the country has always been reported by the State Department to be dangerous for USC to visit / CO's know this as they receive all the warnings and its posted  and has been posted for decades so it was unsafe when she came and meet and married.

 

Reconsider travel to Nigeria due to crime, terrorism, civil unrest, kidnapping, and maritime crime.  Some areas have increased risk.  Read the entire Travel Advisory.

 

There was no good excuse not to meet again and the case looks weak

Ir1 don't have anything to do with k1. I have seen people that their k1 was denied and got their visa in cr1 or Ir1.. 

Moreover the CO didn't asked me anything about my k1. He was specifically interviewing me on my Ir1. After the interview he said my wife income is not enough to bring me over that she should send a joint sponsor. Your advice doesn't sound hope at all

If you do not address the issues that led to a K1 denial, this will negatively affect the IR1. These are just facts, you can look up threads here on VJ on that. Yes people have received CR1 or IR1 after but only because they put effort into fixing the issues. You have not addressed  the  issues - you spent practically zero face to face time with your spouse. 4 years of not seeing your spouse is not normal and that’s a fact too. The excuses you provided do not make sense and are very weak. 

 

You asked if you have a good case or not and I gave you a truthful answer. I don’t see how my answer is not “hopeful”, all I’m stating are factual information. I’m not going to give misleading or sugarcoated answers.

You are missing the point.  Regardless of a previous K-1 denial, you have the burden of demonstrating that you have a bonafide marriage.

 

Honestly, not having seen each other in four years makes it seem like a green card marriage.

 

You may need to spend more time together if you want that visa.

we can not say about an approval but u asked our opinion

and without knowing any other info that would be considered as a red flag,   u don't have a strong case because of lack of quality time spent together and yes,a previous denial of a K1  does not help your case.   CO  did not have to ask u about the K1 ,   all the info was on a computer  in front of the CO

 

BTW  CO can deny a petition for any visa at any time

i married and then 1st CR1 was denied 

so,  been there ;  had that done to me

Why would he? It’s already in the system. He already knows what he needs to from it. It’s not that he didn’t ask because it was all good. Probably he didn’t ask because why would he?

The election is a thing of the past and, unless guerrillas are taking over, for which there would be no election, I am missing the connection between elections and a visit.

How many times did you fiancée visit before you filed K1? How many times did she visit after the K1 denial and your marriage? How many times did she visit after you filed the spousal visa? 
 

A few years back another member told you your K1 case  was not very strong and you needed to marry… 

but getting married was not the only step… acting  like a married couple is also important.

After not seeing each other for 3 years you should have welcomed your wife to Nigeria and even if there was an election you should have told her to delay a few weeks not cancel the trip completely… 

I would expect a denial. And I would tell my wife to visit again soon. I do not think you will be moving to the US unless your wife visits you a few more times while you wait out AP and perhaps even the case being sent back to USCIS (just like the K1).

if by chance your case is not denied… I would still tell my wife to visit because AP can last a long time (even a year). If you are called to a second interview, you want the CO to know you saw your wife while you were in AP.

I believe you have to tell the full story for us to give you more accurate answers.

 

From your previous posts, I gather that:

 

- You filed for a B1/B2 in 2013 and it was denied .

 

- Your first wife, who died in a car accident, died when you had a K3 on file. So that petition was denied as well. For the record, the age difference was 64 (her) and you were 34. That age difference itself does not say much, however, Nigeria is a high fraud country and one of the red flags is when the woman is significantly older than the man. 
 

- Your K1 was denied circa 2018 and you were suggested to file for the CR1. However, just getting married is not enough. I don’t know how you manage to not see your wife, your significant other, who you love dearly, in four years. 
 

Most likely the CR1 will be denied too. And it’s not just because of this marriage, but because of your previous interactions with USCIS.

I looked at your previous posts that @Rocio0010 nicely summarized, and I believe you never had a "good case". Your interactions with USCIS give the impression that your main goal is to get a visa to the US, not to be with your spouse. And the fact that your spouse needs a joint sponsor to be able to support you does not help. You will need to spend a LOT more time together if you want that visa to be approved.

Your denied K1 has everything to do with your now petition. Look at this from the eyes of a CO, Your K1 you said was denied because they didn't believe your relationship was real (probably lack of visits or they were short). Then you married 4 years ago married and she never came back. I am surprised the CO didn't request your wife to get there immediately to visit if you want t to be approved. I have seen this happen about 4 times in the last year in Lagos.
You are married married people are meeting in war zones. Married people don;t go 4 tears without seeing each other unless there are serious issues. Great they only asked about joint sponsor. But he also asked to see your chats from 2022 and 2023. He wasn't convinced you guys have communications of quality. You cam believe they are combing through that thoroughly word for word. I pray your joint sponsor is a strong income person.
And yes there's always hope. So just stay positive and be patient to hopefully hear good news soon.

Oh wow! And my wife and I have a large age difference too, I’m praying mine is different, she’s twice my age, she’s visiting this year, that will make it 3 times she’s visiting, each visit we spend 3 weeks together
