My wife is here on K3 visa, which will expire in April-08 & her I-94 is valed till Jan-09. Last month, I filed her AOS, they sent us the letter with date & time for biometrics to be taken in Aug-07.

She wants to go back her home country in Jan-08 for a month.

My questions are:

Does she need to file I-539 for visa extension before her K3 visa expires?

Does she need a transit visa if her flights changes anywhere in europe?

will appreciate any help...

to my knowledge as soon as you file for AOS you are legal here since your status is pending and your visa "expires" the only thing is that in order to travel while pending you would need advance parole to leave the US ... otherwise they consider your application abdomed!

Thanks for ur reply...I don't understand how can her visa expires eventhough its supposed to expire in april-08.

when I applied her AOS, I didn't file I-131 application for travel documents. does it mean she can't travel till she gets her green card?

K3s do not need AP as they are a 2 year multiple entry visa. If she's going for only a month in January 2008, she can come back as her K3 is still valid as is her I-94. I don't even think you can get a "visa extension" on a K3.

As for transit visas, depends on what her citizenship is. Use this tool from Delta to see if she needs a transit visa or visa to visit other countries based on her citizenship: http://www.delta.com/planning_reservations...rt_information/

By the time she travels, she may already have her greencard. You can also select on that Delta site her citizenship and alien resident of U.S. to see if she'll need any visas for travel to other countries.

Not for K3s, they are multiple entry visas good for 2 years.
