K1 approved after withdrawal, CR-1 pending

Hi

 

We filed for a K1 in August 2022, but decided to marry and refile for a CR1 in January 2023. We sent a withdrawal letter shortly after, but received no acknowledgement, and two days ago USCIS just approved our K1...

Do we need to contact USCIS about this? Or just carry on and let the K1 "die"?

We really don't understand how ours was pulled out of line from August when they are working on Feb/March cases (with cases prior to that still pending!), and we feel terrible about it!!! 😔 we have never expedited or contacted them about it. We are worried that someone else expedited, but they pulled ours by mistake? Has this happened before?

Just carry on.  The K-1 is voided.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yours was pulled out of line BECAUSE you sent in the withdrawal letter.

Adjudicator looking at your case probably forgot they were supposed to DENY the petition (the reason they were looking at it) and loved your evidence so much they approved it by mistake. 

Don't worry about "jumping the line"... you didn't. And the approved K1 cannot be used because you are married. 

Hope your I-130 approval will soon arrive. And congrats on tying the knot!

Panic over then. We will continue being patient and take it as a trial run for the day we get the real notification 😄
