Can we expedite I-129f for Physically Disabled Beneficiary?

Hello! 

I am a Fiancee of a male from the United States, and we've been dating for about 4 years now. Right now, we are preparing requirements for the petition for alien fiancee. I am wheelchair-bound and was born with a degenerative disease called muscular dystrophy (myotonic-congenital type), that causes me to progressively lose muscle mass and my locomotive abilities, and me and my fiance very much wants to be married in the US soon and spend the rest of my life by his side. So, we wonder if our case can be expedited with this reason.

 

Here's a sidenote, I am from a middle-class family in the Philippines. Though we're not able to get the necessary treatments for my scoliosis and other certain health problems because of certain specialists uavailable in our province, we get by very well and my basic needs are sustained by my immediate family (like: foods, dental, doctor's appointment for minor sickness, education, clothes, etc.). I have documents as proof for my degenerative disease, and my fiance also just wants to provide me the quality life I need, treatments that are easily available in US, and just be able to prolong my life and time with him. Both of our families and friends are also very much willing to support us. 

 

Hope to hear you guys' input on this. It would really mean a lot! Thank you all in advance.

K1 has many disadvantages bit maybe ot does not matter in this case.

 

By all means try but I do not see any basis for an expedite.

In your case i would definitely marry and go the spouse visa 

u have help in Philippines for your illness but on a K1 you would need health care insurance in US

it is expensive to buy on K1 but if married ,,  he could add u to his coverage immediately upon US arrival

This is just my guess, so take it with a grain of salt. But I think It would be very unlikely since it doesn't help the USC petitioner, and its not a urgent, sudden, and grave situation.  Even so many USC petioners with cancer get denied. You would need to show that your medical situation suddenly changed for the worse and you are in grave danger and the only solution is medical treatement in the USA.  Just needing better medical care won't be enough.  Medical "emergencies"' are a common excuse and most get denied. 

 

The USCIS website says a reason for expediting for humantiarian reasons would be "sudden grave illness that requires you to be in the U.S."

 

I wonder if in your case a CR-1 combined with a K-3 visa, then some well planned medical letters to expedite might be a better choice.  It might help reduce the risk of being denied a K-1, and might have some medical insurance benefits depending on his medical plan.  But if so, both of you need to be able to emotionally handle being married and then being seperated for a long time until you get the CR-1.

B medical is available for emergency medical treatment

Do you mean a B-2 visa for emergency medical? She would not be eligible for that now that she has a US fiance (or even a US BF). The Philiippines is extremely strict.

It may be tricky but not a definite no. You can only try and the cost is minuscule.

Your fiance may request for an expedite, but set your expectations low that it will be approved.  If it was your USC fiance who has a medical condition, the chances of getting an expedite would be higher.  Still, it won't hurt your case to ask.

I wish you well, but please discuss with your fiance his plan to provide for your health care needs in the US.  It is very expensive, and the best case scenario is that he has a job with excellent health insurance that you can be added to.

 

Unfortunately, I don't see an expedite happening, because there is nothing urgent about the situation, nor would it benefit the USC.  Never hurts to try though.
