I-864 and I-864a, Affidavit of Support

Hey everyone

Just had our legal marriage yesterday and am still on a high. We are both very happy, yet eager to get this AOS out the door before July 30th!

Basically, at the moment, we are living with my wife's parents until we sort out our own place in the next year or so (no time soon anyway). My wife is still a student so her parents have offered to be our co-sponsors (just like with the whole K-1 application) and make more than enough to support us.

So, we started to fill out the I-864 for my wife and one of her parents, and when reading the instructions we notice a form called I-864a Contract Between Sponsor and Household Member. Because we are all under one roof, should the parents fill out the contract AS WELL as the I-864?

I haven't heard of this being mentioned before... so I am slightly confused...

The I-864a is only needed if your sponsor makes less that 125% of the povertyline, and is relying on a household member to commit additional funds to make up the difference.

We live in the same home as my parents, and did not use I-864A, we filed I-864EZ because my income exceeds the poverty line by a large margin, are not using a joint sponsor, and am sponsoring 1 immigrant.

Correct, Sponsor files I-864 and required financial data, and Joint sponsor also files an I-864 with financial data. The I-864A is used for situations where the sponsor or joint sponsor needs additional support of a family member living in the same household to meet 125% povertyline when counting all dependents, and sponsored immigrants.

It is a contract between the household member and one of the sponsors, to provide additional support.

i dont want to mix up things but since my husband didnt have enough income and we live with his family as well we used I-864A ... and so far we didnt get a RFE either ... so i would think we did it the correct way ... just my 0.2cents!
