I would of check to see if CSPA applies

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Priority date May 2008

Approved date September 2020

Ok, so if your priority date is May 2008, then I see that your priority date became current July 2020

https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2020/visa-bulletin-for-july-2020.html.

How old were your kids on July 1, 2020?

Double check your i-130 approval date.  It seems super unlikely that your i-130 petition was approved in Sept

2020 and you were DQed Sept 2020.

Find your EXACT i-130 approval date and you get to subtract the time that the i-130 petition was pending from your

children's age on July 1, 2020 (again, always need exact dates).

Thank you very much for the explanation and patience.
There was an error

1)The priority date is 8 May 2007

2)Kids were 18 and 21 by July 1 2020

3) not sure where to find the I-130 approved date but got receipt to fill Ds260 form online in May 2019.
4)confirmation date for completing DS260 to be March 2020

5) DQ is sept 2020

Thanks a lot

Your priority date became current August 2019.

You can subtract 12+ years from your children’s ages (if the 2 dates you provided are correct) on August 1, 2019.

Your children did not age out and cannot age out.

Your biggest problem is going to be the health of your sponsor.

Your petition is dead even if your interview takes place if your petitioner dies before you arrive in the US.

For this reason, it’s good to have a younger sibling or younger parent have separate petitions for you.

And be prepared to file for humanitarian reinstatement should this happen so you can reuse your priority date.

Maybe look for Nigerian posters.  See what cases they are processing.

Get your US relatives to contact their senator.   This is almost 3 years.
