How do I answer I-485, Part1, Q24 "What is your current immigration status (if it has changed since your arrival)"?

Thanks for your perspective.  These are due by May 8 or the case is considered abandonned.  Think I have time to get it there via snail mail?  Recall it isn't the postmark date that is critical but they date they get it (not sure if it is the date the receive it or process the contents of the envelope).

The more I think about it, I think that phrazing "if applicable" in the RFE sentence that said "...or scan and upload your response using your USCIS online account (if applicable)" is probably just referring to some people who never created an online account at all and so it isn't an option for them.  But I could be wrong.

USPS flat rate priority mail. 99.99 percent certain to get there in by May 8. 99 percent certain in 5 working days. Upload on May 6 if it is not there yet.

Appreciate your help today.  BTW, I'm leaning towards uploading this RFE response.  The taxes and proof assets forms would probably be something like 500 pages minimum to mail.  (Complicated taxes).  Also, I was able to upload passport style photo for the I-130 petition that was submitted online and they didn't have a problem with that (so there is precedent for them accepting the passport photos online). 

Another factor is influencing my thinking on uploading vs sending via snail mail.  On my wife's USCIS account, there is a button we can click to upload the RFE response to this specific RFE.  Since both the I-864 and the I-485 are both submitted by regular mail orginally, if they didn't want us to respond online to an RFE for those specific forms, I don't think they'd have a button ready made for us to click and upload docs.

But I will ponder that decision a bit more. 

Really apppreciate all your perspective.  Crazy thing is how you get different answers for same quesitons on all of this.

One last point on uploading photos.  See below image.  Looks like this was ready-made for us to respond to this RFE with an online response.  I was probably overthinking this.

Just from a personal perspective, be sure to mail in as well as upload. I know when my case prior to approval was hit with a NOID, (Notice Of Intent to Deny) we got no response from USCIS with the upload. When we mailed in we got response within a matter of days of receipt and action taken on our cases.

(Our best guess is they lost some of the pages at the USCIS facility.) We are now beyond the date in March that her original I-94 B2 status allowed her to stay in the United States. We do have an I-797C Notice of Action form from January showing she is here temporarilly legally while the request to adjust status is processed. Just not sure what to put in Part 1 Q24 of the new I-485 as I don't think she is still in B2 status. Welcome any guidance.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I485 cannot be filed online unlike the I130 hence the using your online account to submit RFE documents. 

 

 

 

You can only mail.

You are correct about not being able to file the I-485 online, however the beneficiary is able to upload evidence and RFE responses on the online account that is linked to the I-485 on their my USCIS account. I did when I was in the process🙂

Able to has never meant eligible to.

That's what if applicable means in the instructions.

Agreed, if instructions don't mention uploading evidence, it's a 50/50 chance IO will even take anything uploaded into consideration.

Thanks for your response.  Did you actually get an RFE in response to your original I-485--and did you upload a new I-485 in response to that RFE?

The I-864 also can't be filed online, but in the RFE part of the website, it specifically has a field you can select stating you are uploading an I-864.  We all agree that both the original I-485 and I-864 can't be filed online originally.  The question is whether they both can be uploaded in response to an RFE.  I appreciate your input as I'm not certain.
