I am almost done putting together my I-130 and I-129F packages. I am sending them together as instructed by USCIS. As stressful as this is, I would be batshit if it were not for all the help and info on VJ.

I have a few questions.

The K-3 FAQ states the following about what to include in the I-129F package.

In short, your package must contain everything you sent for the I-130...plus a copy of the I-797 Notice of Action you received after filing the I-130.

Does this mean I need to include all the bona fide evidence that I am including with the I-130? The K-3 visa guide and the I-129F instructions don't seem to require any bona fide evidence.

Also, the guides state that I should make copies of the packages I send in. I have actually created the majority of the package in electronic format. I have PDF documents containing every form, document, photo and other evidence I am including. I can print out exact copies of the entire package very easily. I also have the original versions of the important documents and extra signed versions of my wifes G-325A. Will this suffice, or do I need to actually photocopy the entire package?

Also...

Do I need to include phone records, chat transcripts, etc at this stage?

I am already including the following.

- Photos from various visits and vacations(some with her and my relatives), as well as wedding and honeymoon photos.

- Life insurance form adding my wife as beneficiary.

- Receipts from bank transfers

- Airline tickets and hotel receipts for both of us when I visited her or we traveled together.

I can add extensive phone records and chat records, but they would add a huge amount of bulk to the package.

If you have limited finances you may want to re-consider the K-3, the added fees are quite high ($170 I-129F, and $1010 AOS), if you stay with the I-130 petition it results in a CR-1 visa, which results in a green-card upon entry to the USA (NO AOS needed).

The CR-1 has been taking a few weeks to a month or so longer than the K-3.

I don't have limited finances, so this is a non-issue and has nothing to do with what I asked.

I am well aware of the additional costs involved in AOS, etc. and I don't care. An extra $1,000 or so is a small price to pay to get my wife here as soon as possible, even if it is only a month sooner. She will not be working for a good while once she gets here so the K-3 is the best option for us.

Unfortunately the guides have not yet been updated to reflect how to file the petitions together or for how to comply with the new bonafide relationship requirments in the new I-130 instructions. I would advise that you don't duplicate the bonafide relationship documentation with the I-129F. You're filing them together anyway.

Any way you are comfortable duplicating the submitted paperwork will suffice. It is for you.

A further thought is now is the time to decide whether to clearly indicate on your I-130 that you want Consular Service. If you do not, your I-130 will be held and you will not have the CR1 option. This is entirely up to you and how to successfully "clearly indicate" the desire to keep the I-130 moving is an unknown. My thought is to use a red sharpie on the top of the first page saying "Consular Service Please" and put the same in bold in your cover letter. Of course if you want your I-130 held up, disregard.

If both the I-130 and I-129F are approved at the same time, would the K-3 still be faster? Doesn't the CR-1 still require some additional steps with USCIS before it is sent to the Embassy? I am not concerned with the additional cost and steps involved in AOS for the K-3.

The I-129F would be faster, but if your NOA1 comes. I never received mine, I received only the NOA2 3 months later... and now I still have 2 horses running. You need to consider the delays don't take for granted that the I-797 will come right away.

The extra steps are at NVC. Did you read the guides? Yes the K3 would still be faster.

The I-129F would be faster, but if your NOA1 comes. I never received mine, I received only the NOA2 3 months later... and now I still have 2 horses running. You need to consider the delays don't take for granted that the I-797 will come right away.

K3 filers don't need to wait for NOA1 anymore. They file both petitions together with CSC or VSC.
