2 or 10 year Green Card

I have a question, I married my spouse in July 2021 and for reasons beyond our control, he returned to his country before the green card was finalized.  Once he left I applied for a spousal visa which is now making its way through the NVC.  If he is approved for his visa AFTER July 2023, that means we have been married over 2 years, though only living together 6 months.  In any case, will he get a 2 year or 10 year green card?  Thanks

It is all determined by the date he arrives into the US. If by that date you have been married for 2+ years, then he gets a 10 year.

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

if u pass 2 years marriage anniversary before he enter USA = 10 years

Also for timing purposing,  reminder the spousal visa will likely expire 6 months from the date of the medical interview.  And you can slow things done by not finishing the NVC stage.

with the tip to if you are delaying more than a year,  this bit of instructions I failed to note the author of:

"Use the AskNVC web portal.  Only a simple message is required, such as “I need more time for our case.  This is my record of annual NVC contact.”  Upside:  You will receive an immediate automated e-mail record of your contact with NVC including all the communication detail.  In the e-mail, it states: “Please retain this email as a record of your contact with NVC”."
