Name Change & Social Security #???? Help!

Filed: K-3 Visa Country: India
Timeline

She's been approved on a K-3 Visa and her I-130 has been approved. Three things left: 1- adjustment of status. 2- change her last name to my last name. 3- get her a social security card and number.

HOW and in what ORDER is all this done?? I applied for the AOS this morning. Do I now get her name changed or do I get her Social Security card first? The AOS forms had her maiden name with no SS#. Am I permitted to change these?

K-3 Visa

07/22/2006 - Applied for K1 - I-129F mailed to Vermont Service Center, VSC

08/02/2006 - Package got sent back requesting a different form (different revision). Proceeded to weep like a girl. Decided against fiance visa with newfound setback. Will wait for December wedding.

12/24/2006 - Marriage

02/05/2007 - I-130 sent to VSC and confirmed receipt following day.

02/13/2007 - I-130 NOA1 received

02/15/2007 - K-3 sent to Chicago and confirmed receipt following day.

02/26/2007 - K-3 NOA1

03/02/2007 - I-129F (K-3) sent to Vermont Service Center (from Missouri Service Center)

03/11/2007 - Received email notice: I-129F in VSC is now pending (whatever the heck that means)

04/05/2007 - I-130 and K-3 APPROVED! (email notice) (rec'd postal mail 04/13)

04/09/2007 - NVC received case (called 603 334 0700)

04/11/2007 - Shipped to Chennai.

05/17/2007 - Received confirmation of receiving package via postal mail in India with interview date! (took 36 days!)

06/15/2007 - Interview! VISA APPROVED!!

06/29/2007 - She's in my arms...

Timeline

For K-3,

  1. You can first file for EAD, using code (a )(9 ) this results in an EAD that expires the same date as the I-94 (2 years)
  2. File for AOS in married name, this should be on the marriage cert if you elected to change name when you married.
  3. When you get either EAD or Green-card, wait a few weeks and then file for SSN.

Get SSC first be sure to bring your marriage certificate proof of change name, passport and I-94

you need to correct information on your SSN card, or information shown

in our records (e.g., a name change, or corrected date of birth), you will need to prove your identity and

provide documents that support the change and establish the reason for the change (e.g., a birth

certificate to show your corrected date or place of birth). A name change document (e.g., marriage

document) must identify you by both your old and new names.

No eligibility for SSN until she is work authorized (which she is not currently)

Only K-1 visa holders can get SSN first, the OP entered on a K-3, they either need EAD or Green-card to apply for a SSN

So I guess the SS card is not an option because of what you just said - no work permit and no greencard (yet). Marriage certificate has her original name on it because we are electing to change it now, not then.

But - how do I get her covered under my health benefits when she has no SS#?

Now AOS is processing. I have to wait until either they issue her a SS card - or we get the work permit and then apply ourselves. And as far as the name change, I have to do that during the AOS processing??

URGH

SSN is not a requirement to add a spouse to a medical policy. You are not required to give out SSN to any non-government agency, that goes for banks too when adding to a bank account, though the bank can refuse to do it.

I just went to my employer's HR department and added my wife before SSN, and just wrote "NONE" on the form, and the insurance company had no problems adding her.

You guys are fantastic. I got her on my benefits policy with no SS needed (had a 20 min hold time though).

So that's it - get her name changed, notify USCIS, and wait for the social security card to be issued. Right? In this order?
