Fafsa eligibility if I90 in process for erroneous green card (merged)

Your 2 choices:

1. Continue w life and use the plastic card w “as is data” expiration for all needs. Do not explain error to other agencies. Wait for I-90 to resolve 

 

2. Get InfoPass, go get a stamp in passport , show the correctly filed I-90, surrender the plastic card on the spot and use the ADIT stamp as proof of LPR heneceforth.

Will look into getting the ADIT stamp after sending the ROC package because that's the main focus at the moment , will try option 1 till then,if allowed and accepted.

Your I-751 window opens July 2023. Unless the I-90 issues you at least a paper decision by then and your I-751 bounces back, then InfoPass to surrender card and ask them to at least notate record correction urgently needed

I am pretty sure the window opens in June 2023. I don't know what u mean by I751 bounces back?

Ah, I apologize. By allowed and accepted I meant if the erroneous card is allowed and accepted to be used for things, in this instance fafsa. I am planning to add the I90 paperwork with the ROC package so hopefully the bounce back of the ROC isn't an issue.

How? Is there any downside to getting an ADIT stamp? I have never tried it before so open to learning new information. Another poster suggested it so I said I might look into it.

The erroneous card ( in your hand) is what is currently reflected in The System ( SAVE for example..) so I don’t think you will have problems. 
 

Hopefully I-751 is accepted from get  go. 
 

ADIT stamp and plastic card surrender is in your future even w successful I -751 Receipts and Extension Letters…as they are related to date on plastic card.

 

@Mike E, will hopefully return w input..Las I do not know him to back down from taking a position w opposing views 😇

You are voluntarily trading a document that shows evidence of status for 10 years for one that usually has evidence for just one year or less. This compromises your ability to operate in society: drive, travel, get a mortgage, get and keep a job, etc. Once you give up your gc, the 48 month extension letter is useless.

 

You might be thinking USCIS is going to process your I-90. In most cases like yours that does not happen.

 

In addition there is an outside chance, USCIS will deny your I-90 and I-751 because it insists your 10 year gc was not issued in error. Well if you gave it away, what then? File I-90, and hope USCIS does not charge fee. Why shouldn’t it charge a fee? You made the choice. Either way most I-90s take 2 years. 

 

By all means, surrender your 10 year gc when DHS commands. You did your part: you paid money for a gc, you filed I-90. It is on USCIS and not you to fix its mistake.

I agree with keeping plastic card until a successful I-751 is lodged…because if /when it’s accepted it means OPs record will be updated to Conditional Resident and he will continue fully functioning with the ADIT stamp. 
Continuing to use the 10 year plastic beyond that invites unnecessary headaches…

I am only speaking on the FAFSA and college application here…

 

FAFSA only asks you your USCIS number and the date you became a resident when it comes to your LPR and GC.  It appears the issue is only on the expiration date of your card.  So, you can apply for the FAFSA using your USCIS number (which if it is correct, it won’t change) and the ISSUED date on your GC, which is the date you acquired your legal residency.  If the issued date is correct, then you can apply and FAFSA will confirm your status.  It doesn’t ask you for a picture or anything like that and the expiration on it is not asked.  Make sure you fill out the one for 2022-2023 and 2023-2024.  Also, you will need other personal information like SSN, DL, tax returns, etc.

 

When it comes to your college application, it will depend on your college.  Some colleges require more information than others.  But, again, as long as you provide the accurate information and let them know the misprint or whatever, you should be fine.

 

My husband just applied and started college a few weeks ago, so this is coming from a recent experience.  We did not have an issue with a misprint on the GC.  But, we did go through with everything using the expired GC + 48 extension letter.  No issues, we were even lucky with FAFSA assistance.
