Fafsa eligibility if I90 in process for erroneous green card (merged)

Spouse in the process of going to community College. They were wrongly issued ten year green card instead of two. (K1 aos,married less than 2 years). Filed i90 to fix that but it's still in the process and they still have the wrong green card in their possession. Can one apply for fafsa as a conditional green card holder with a I90 in process? Will this cause any complications? Personal experiences most welcome.

I don't see an issue.  Your spouse is a legal resident with either card.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am sure it doesn't cause any issues.  Legal Status doesn't expire when the card does.  That date is the expiration date of the card.  There are no issues for N-400 filing.

Yes.  The card is evidence of legal resident status.

The incorrect date reflects ONLY the date the card expires.  It does not reflect expiration of legal status.

Agreed. There are some here who disagree claiming that this breaks good moral character. I am not seeing it.  LPRs — with green cards that have errors they did not cause — should not be required to forgo entitlements.

If an LPR with an unexpired 10 year gc can get a government benefit, so can an LPR with an unexpired 2 year green card.

 

It is when a green card expires that we see stark differences in how the law treats the 10 year gc holder versus the 2 year gc holder.

The green card will expire (if it had the right expiry date) in September 2023. But because of the error it says it expires in September 2031. Does that make any difference while applying for fafsa?

The only issue I see will be if you fail to remove conditions as required.

Great.  Remember, N-400 can be filed when spouse becomes eligible......even if the I-751 has not been processed.
