K1 visa application correction by new application

Sorry, old topic but new questions. We made a date mistake regarding our in person meeting. I stated that we met in 2020 rather than 2022 on the form then referred to my attached letter and evidence for more details. I'm my letter I made another date error about 2021 in one place rather than 2022 but all of my evidence, boarding passes, ring and hotel receipts in Philippines etc have the correct dates. I'm worried that the reader may reject it at first glance and we will be set back another 18 months.

 

Some have stated you can submit an updated 129f while the first is still pending. Is it really possible to have a second application in queue while the fist is still pending. Uscis customer service has been useless regarding corrections etc. Only giving me wild goose chases the take over a month to learn were useless. Thank you all for any helpful information

Given the series of errors I think you should hire a lawyer.

 

If you still want to DIY, then choices:

 

1. Get married, withdraw I-129F, file I-130. This is better than filing a new I-129F.

 

2. Withdraw I-129F and file a new one

 

3. Send unsolicited evidence for the existing I-129F. I share your pessimism about this working.

Tough call on this one.  There is no guarantee that you can update the I-129F.  Based on those errors, you might face a rejection.  I don't think I would send a 2nd I-129F without withdrawing the 1st one.  If you do that, you might as well marry online, meet, then start the spousal visa process as @Mike E commented.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Submit an e request to correct typos. Print it out and also do a paper mailing to the address on your filing receipt. One of the two will definitely make it to the file . Do a simple letter Supplemental Filing Request for Record Update due to typographical error. Include copy of Receipt Notice .

 

Your case will not be denied, at most an RFE …do NOT refile.

I tried this online after being directed by customer service. After a month or two of waiting  for the reply I was told that this only applies to typos that USCIS made on documents to me

I will humbly dismiss the many creative responses that tier 1 agents come up with and suggest you don’t worry . If you already did an e request , then include copy of it along with the above mentioned paper mailing of the letter /supplemental filing to update record. 

Do not wait for any response , case will be worked only they get to it.

 

As for the e request , it is indeed for errors noted on generated receipts..,but as it is an effective way to generate a digital effort, always worth doing..until they go all digital.
