1. On the I-864 instructions, it says not to send in the W-2s and 1099s if you have an IRS transcript. The checklist on page 11 wants the W-2s with the copy of the return. I have the transcripts from the IRS. I've also seen people advising people to send in the W-2s and 1099s. Thoughts on this?

The I-134 is needed at Interview time, not at application submission time! I don't believe you need an I-864.

If you are doing a K-1 Visa, you should be preparing an I-134, not an I-864. At the Interview, the beneficiary will need the I-134 with your signature notarized. A copy of your most recent tax return with W2 will also be required, along with a letter from your employer.

You send either transcripts, they have the data they want to see. OR you send 1040 with W2 and/or 1099, the W2/1099 prove the numbers on the 1040.

So if you send transcripts, you don't need to send W2/1099

The I-134 is needed at Interview time, not at application submission time! I don't believe you need an I-864.

If you are doing a K-1 Visa, you should be preparing an I-134, not an I-864. At the Interview, the beneficiary will need the I-134 with your signature notarized. A copy of your most recent tax return with W2 will also be required, along with a letter from your employer.

This question is in the AOS forum, the I-864 is sent in with I-485. The OP is way past visa interview.

We interviewed in February, joeyjoey. And then we did submit the I-134, which is a greater pain in the ### than the I-864.

Thanks, Dan. I normally default to following the instructions on the forms but that's not always foolproof. It does seem like they don't want to be mucking around with W2s if they have all the evidence confirmed by the transcript.

However, you must distinguish between the free transcript and the $39 transcript. The $39 transcript from IRS that has all the info. The free transcript will result in you having to attach the W2 and any 1099s you may have. So, when you wrote "It does seem like they don't want to be mucking around with W2s if they have all the evidence confirmed by the transcript. ", you were absolutely correct.

I can't say this is entirely true. No where on the 864 instructions does it distinguish between the two transcript types:

If you provide a photocopy of your tax return(s), you mustinclude a copy of each and every FormW-2 and Form 1099that relates to your return(s). Do not include copies of theseForms if you provide an IRS transcript of your return(s) ratherthan a photocopy.

IRS Transcripts (which will serve most visa-related purposes/have all the information) are Free - Can request up to four tax-years per form (form 4506-T).

Actual copies of previously filed tax-returns (which would also serve most visa-related purposes, but would not make a lot of sense to get) are $39. Unless you have some special reason to need this, the IRS Transcripts would be the way to go. (form 4506)

IRS Transcripts (which will serve most visa-related purposes/have all the information) are Free - Can request up to four tax-years per form (form 4506-T).

Thanks for that - I was worried for a second there...

Caladan - we sent this year's tax return & W-2 (C. apparently doesn't have any 1099s) and transcripts for the previous two years without anything else. Don't know whether USCIS are happy with this or not though - all I can say is 'no RFE as yet....'.

Right. I ordered the free transcript by phone because there didn't seem to be a reason that I needed the physical copy of the tax return.

Moi... and so far, no RFE. Ordered ours on the telephone and got it in the mail 6 days later. It was amazingly quick.

I sent in three years of tax info. For 2006 I only had the copy of my tax return and w-2s because we filed in March. For 2004 & 2005 I sent only the free tax transcipts without any other additonal paperwork. The green card was approved without any RFEs.

From the instruction it seems that transcripts for the previous two years are optional. If you included them, why did you do so?
