My brother in law flew away after he got green card

My sister, who is a US Citizen, got married to her husband in 2019 in India. My brother in law had a previous marriage and he had a dowry case on him from his previous wife. He made us believe that the case was closed and his previous wife falsely put a case on him. We believed him and later when my sister got married, it took him longer to clear the process. I am also confused how he was able to get a police clearance certificate in India because dowry case is a criminal offense. In Aug 2022 he immigrated to US and got an unconditional green card in a month. In Feb 2023 he flew away and he just texted my sister saying he is going away to India. 
 

3-4 days later he called my brother and told him that he is going to divorce my sister. 
 

clearly this is immigration fraud. Is there anything we could do.

Few other types cases gave me the satisfaction that putting away a marriage scammer has. The emotional toll on the conned partner was intense. Most people don’t even realize it’s a crime and we surely prosecute it

What am I missing, he said he is going to divorce her and return to India.

 

If he had a criminal history which seems a guess, why did it not appear on his record?

So why would ICE have an issue with a text from a LPR saying he was going to India, and then did not?

 

Possibly this may come up if he wishes to Naturalise, if he has an undisclosed Criminal History that could certainly be an issue. Obviously no need to Naturalise and we do not know if he has a record.

The purpose of the IR1 was to live in marital union with the petitioner. Based on what has been presented, the beneficiary misprepresented, which carries a life time ban. 
 

If you do not believe an ICE agent when she says she arrests for marriage fraud you can take it up with her.

They have been married 4 years, how many cases do we see on here that do not meet the 2 year mark and have no issue removing conditions etc.

 

Lets say there was an issue regarding Dowry payment and a prior marriage, something ICE will get excited about? Seems like a lot of work for something that is not even an issue in the US. And that would not be a marriage fraud issue anyway.

OP, I am not familiar with Indian law or dowries. 
 

Are you saying that he has committed bigamy by remaining married to the first wife while marrying your USC sister?

i know India have some law banning Dowry, seems not very widely enforced and still a cultural thing. I am assuming the family should get the Dowry back after divorce and that did not happen.

Oh, I see.   Then it is really more like defaulting on a debt owed, which I doubt ICE is going to care about.

 

If it was marriage fraud,  it will be very hard to prove.  However, if he divorces and then attempts to petition a new wife, I’d expect scrutiny.
 

Chalk it up to another reason to perhaps date locally, since with overseas relationships it is much harder to really get to know a person’s character.

I assume they are all Indians here and the wife has US Citizenship. Could be an exception but that seems to be the norm.

I would assume so too, but bringing over people from your country that  you marry without knowing well should be a caution for everyone.
