Hey u all 

 

i need to help i don’t know what to do at this point i got naturalized 3 days after my newborn baby and i can’t  transmit my citizenship to him cuz he born before i got naturalized

by the way i filled i 130 for my wife back on june 2022 but her petition still pending didn’t get approved yet so my question is what to do about my son he is 2 months old , should i file i 130 or him as well or what is the process for this kind of case

If you waited to naturalize, your child could have been a derivative of your wife, category F2A.

 

Now, the only option is I-130 for your child.  You can delay your wife's case at NVC until your son's petition is approved.

where was the baby born?

if the baby was born in US ,  the baby is a US citizen

file the I 130

stall the mother's case at NVC (1 year if u have to)  to allow the baby's to catch up
