Stuck on filling out I-864A and I-864 forms

Hello everyone. I have just sponsored my fiance to come to America. We have gone to court to get our marriage license, and also went to the social security office to apply for a SSN for her. My next step is to apply for a greencard for her. As her husband, I will be the one sponsoring her but do not meet the 125% poverty income requirements, so I will use my mom as the joint sponsor. Do I fill out the I-864 and my mom fills out the I-864A?

 

I currently live at home with my mom, grandmother and my mom's younger brother, and my wife. I am not sure what number I should use for household size on my I-864 application? And on Part 6 section 8, should I put my mother's name along with her current income from her latest tax return transcript?

 

Part 6, section 21 and 22 - I'm unsure of what to check or do here. I've attached and circle below the areas that I have questions about.

Part 7, section 5a - My mom will be acting as the joint sponsor, so she will be filling out the I-864A, not sure what to put down in 5b.

Part 7, section 6,7,8 - I'm assuming the "principal sponsored immigrant" is my wife? and if so, does this section need to be filled out. I know it says optional, but I just want to be sure I'm doing everything correctly.

Part 1, section 1 - I have checked 1a, since my wife came to america on a K1 visa. Is this the correct choice?

Part 2, section 2a - Who do I put for the "In Care Of Name", and do I use my current's resident address in this section?

Enter 1 in for persons being sponsored

 

Leave currently married as blank

 

Numbers 1-7 will add up to 2


On the asset stuff change total to 45,000. Leave rest blank

If principal immigrant does not live at the mailing address, enter the name of any adult resident who lives there. Otherwise leave blank

Read the form:

 

Part 5. Sponsor's Household Size

NOTE: Do not count any member of your household more than once.

Persons you are sponsoring in this affidavit:

1. Provide the number you entered in Part 3., Item Number

29.

Persons NOT sponsored in this affidavit:

2. Yourself.

3. If you are currently married, enter "1" for your spouse.

 

If you do it your way (the wrong way) your  total will be 3 and not 2. You might generate an RFE because USCIS might think you have multiple spouses.

 

I-864 is a challenging form for simple cases. Your case is not simple and so you should consider hiring a professional.

Thank you for pointing that out and clearing it up for me. Appreciate it greatly.

 

Just for confirmation. There are 3 versions of this form: I-864, I-864EZ, and I-864A. My mom will be the joint sponsor as she meets the required 125% poverty income level to help my spouse get her greencard. So she will be filing form I-864 or I-864A? You mentioned that we both needed to file I-864 and I just wanted to make sure that I am filling out the correct ones.

I'd also like to point out that my mom and I live in the same house. Does this make a difference on which form needs to be filled? I-864 vs I-864A?
