Will the USCIS delay recieving the I-129F petition for the new fees

Timeline

My wife sent the I-129F for K-3 visa in 07/15/2007 but she forgot to attach the check. the USCIS supposed to send it back for her but till now there has been nothing got from them.

Do you think they may delay it till 07/30/2007 that there will be no fees on the I-129F???? :unsure::unsure:

Appropriate fees are determined by the POSTMARK! It maybe a while before it gets returned. I would be prepared with a second submission and get it out before 7/30 if you can

I don't think they will. USCIS is famous for failing to address all the issues. There is no reason to assume that if you paid the lower I-130 fee that filing the I-129F after July 29th will result in no fee. It's just an issue they will decide how to address once somebody pulls their head out of....

Facts are cheap...knowing how to use them is precious...

Correct me if I'm wrong, but I thought that for K3 visas, the new fee for the I-129F is $0. Then they would have to pay the higher fee at the time they file for AOS.

If this is the case, then once the USCIS returns your I-129F for not having a check you just re-send the form without payment.

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

The question remains (and i think was was pushbrk's point) is can you file an I-130 pre fee hike for $190 (vs $355) and file your I-129F post fee hike for free (vs $170).

You may be right on this.

Fee Increase Information:

Effective July 30, 2007, the fee for general fiancée petitions will increase to $455. All petitions postmarked on or after July 30 must be accompanied by the new fee.

Petitions for K-3 status based on an immigrant petition filed by the same U.S. citizen husband or wife will have no fee.

Makes no mention of cases where I-130 was filed before rate increase, and I-129F filed after the rate increase.

Looks like it may be up to USCIS to decide either to return it for fee ($170), or keep it for no-fee processing.
