Baby waiting for I-30 approval

Hi, 

 

My wife the American citizen applied for my green card (both live in the U.K) 

 

My wife is pregnant with our 3rd child (other two children are American citizens) and our 3rd will be eligible also. 

 

My wife is due in November and my approval expectation is not until January 2024. So most likely new baby will be here before I get I-30 approved. 

 

Should we make USCIS aware, or does this not effect anything as the baby will become an American citizen in its own right.

baby will be American too.  you just need to file https://uk.usembassy.gov/u-s-citizen-services/citizenship/consular-report-of-birth-abroad-crba-and-first-u-s-passport/

You can add the baby to your DS260 Application (not as a derivative who needs to travel but as another child/ addition to the AOS requirements).No need to inform them now.

My wife moved to the UK only 5 years ago (she is 28) so that is fine. Our second child was born in the UK and we had no problems getting his American citizenship. I am pretty sure there is also another element to that where it says about since the age of 14, which she has

there is / that is one part of what she needs but my understanding is it's not either or 

need more info from the more experienced VJ members

If your wife was able to get CRBA for your 2nd child, then she would have no issue getting CRBA for your 3rd child as well.

 

As mentioned by @ROK2USA, just provide your new baby's info on your DS-260 form after the I-130 is approved.  No need to update the petition or inform USCIS.

 

Also, for the DS-260 question about whether your USC wife/children will be immigrating with you, answer "No".  USCs do not immigrate to the US (they just relocate).
