Only EB1/EB2 update on NVC (DQ, IL)

Hi all,

 

I am documentarily qualified (July 10, 2024) and my PD is current at Dec 15, 2021 (my request to recapture this earlier priority date was approved 31st July 2024). My consulate is Frankfurt, Germany.

 

I am yet to receive my interview letter? I am worried that there could be a backlog now that Frankfurt is processing immigrant visa for 5 other consulates. Anyone with an idea on Frankfurt processing and how long it takes to receive the interview letter? Thanks.

Which category? Please fill in your timeline, thx. 
 

If your request to have an earlier PD recaptured was only approved at the end of July then it’s probably just too early to be expecting a IL. What does your case status say?

I've filled in my timeline but for some reason it's not showing up.. 

 

If it still says at NVC then it hasn't been transferred yet. A reasonable time would be anything less than the 2 years it takes at the consulates with the longest waits! But hopefully much less than that, 2-3 months is about the norm for a quick consulate.

The annual limits for EB1, EB3 & EW, and EB5 have all been reached, so if you are EB1/3/5 and you don't have an interview scheduled yet, chances are you'll need to wait until the new fiscal year (October).

Yes, the immigrant visas won't be issued until October 1st. That's what DOS said in the link.

Since all available EB-1 visas for FY 2024 have been used, embassies and consulates may not issue visas in these categories for the remainder of the fiscal year. The annual limits will reset with the start of the new fiscal year (FY 2025) on October 1, 2024. At that point, embassies and consulates may resume issuing immigrant visas in these categories to qualified applicants.

Just refreshed my status now and my visa has been issued few minutes ago. EB1-A too, so it appears anyone that had an interview held and visa approved at the interview before the numerical limit was announced will get a visa.

Actually, I later discussed this with other people; someone pointed to me that DOS allocates a visa number when they schedule an appointment. 

 

"Visa numbers are always allotted for all documentarily qualified applicants with a priority date before the relevant cut-off date, as long as the case had been reported to VO in time to be included in the monthly calculation of visa availability."

So I guess people who are included in the "monthly calculation of visa availability" actually already have a visa number allocated. And since the monthly calculation happens at the beginning of a month. (On the visa bulletin of September, one can find that the date was August 2nd). In the rare situation where the visa is eventually refused, this visa number will be returned to the pool. Otherwise, I think people with interviews scheduled in September should have their visas issued as usual.
