We have an interview coming up in Montreal, Canada for my spouses IR1 visa. We also have a joint sponsor. I was looking through the interview checklist and noticed that if the joint sponsors tax return is marriage filing jointly, then the joint sponsors spouse has to fill out an I864A document. I am very worried because the NVC never asked for that so we assumed it wasn’t necessary. The vast majority of their income is from the joint sponsor. My question is, do they have to fill that out even if the NVC didn’t ask for it?

Is it wise to bring this years tax return as well?

Its not necessary if the joint sponsor’s individual income exceeds the requirement and  is documented fully  .. but many recommend it as it indicates the joint sponsor’s spouse is in agreement  

 

Yes bring the 2022 tax transcript if you have it in hand

I would have an I-864A ready.  The CO has discretion to require it.  What NVC did is irrelevant.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
