I just got back from the interview,  no much question, went smoothly but asked for a Joint Sponsor.  My husband made 60k for 4 house. I don't understand why they need a Joint Sponsor.  

 

Here is the thing, we don't have anyone to ask to Joint Sponsor us. Can my husband write to the consulate know why they need a Joint Sponsor when he made 60k which is far above 125% for 4 Household

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Could be the self-employment side of his income.  Your husband can ask, but I wouldn't expect them to change the decision.  It's better to try to give them what they want.  Good luck.  I hope your visa is issued soon.

Self employment cases are more difficult to get approved and in my observation successful cases have required more documentation. 
 

1. Is his taxable income in each of 2022, 2021, and 2020  over 60K? Self employed people tend to take deductions that lower taxable income.

 

2. Does the trend for 2020, 2021, 2022, show that he will continue to have taxable income more than 60K for future years)

 

3. What of his earnings for the past 12 months? My observation is that successful self employed I-864s include bank records showing sufficient income.

 

4. .Did you include his 2022 schedule C?

 

5. Is his W-2 income more than $37,500?

 

6. Does he have any liquid assets based in U.S.?

 

7. Does does he live in the U.S. and is all his income from U.S. sources?

My husband works as employee and also have a business he runs as side. Both income makes 60k in 2022 but not up to in 2021 and 2020.  He will continue to make 60k in 2023 or more.

 

W2 for 2022 is 38k

 

Just his own house and 401k 

 

Yes live in the USA and all income from USA

Seems to me the CO is not considering his self employed income.

 

So you, him, and your child are 3 in the household. Who is the 4th and is there a 5th?

It would be best if the USC was here as he will be the one to follow thru with what the embassy wants or to further explain his situation

 

there are 2 ways to file business taxes (1 with his normal 1040 and and schedule C or the other to separate business and personal)

if he used 1040 EZ for his personal taxes (separate from business)   the following is what embassy looks at the following as stated in I 864 instructions

 

Business may be doing well but if he reported a loss then it takes off from his personal tax returns when filed together 

 

For persons filing IRS Form 1040 EZ, the line for adjusted gross income will be considered.

 

All things to be considered the USC needs to ask and get answers /not sure why NVC didn't notice and send RFE for explanation as he best knows

I asked about schedule C twice now. Silence is an answer. So no schedule C submitted.

If you are filing for spouse (IR/CR1) and child (IR CR2) then the sponsorship is required for EACH one individually. So I 864 for each one. Note .. only count 1 immigrant on each I864 .. for spouse do not also count child in the sponsors household and visa versa
