Ex husband threatened to take my green card

Good luck! I believe you don't need a lawyer regardless if he sent the letters or not. Let us know how it goes please. 

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

05/27/2016 - N-400 mailed

06/02/2016 - NOA date

06/24/2016 - biometrics appointment

11/28/2016 - interview scheduled for January 9th, 2017

01/09/2017 - interview passed

01/20/2017 - Oath Ceremony

He cannot take you green card away. Period. End of story.

File under the five year rule and you'll be fine. I'm so tired of hearing about spouses threatening to "take green cards away" from exes, something they have absolutely no power to do. He had to file mountains of evidence to prove the marriage was real and now he wants to say it isn't? If that's the case (we know it isn't) he, himself, would be guilty of fraud.

Me too!  So many people seem to have this entitlement, that they "own" the spouses green card/visa because the spouse got it through marriage to them.  Nope!  The green card belongs to the immigrant and no longer has anything to do with the US citizen.  Can you imagine how many bitter letters USCIS has to read every year?

On J visas.  Spouse won DV lottery while in US.  Did AOS from the US.

 

Boston field office, GC holder for 10 years.

Citizenship received in 2016, took ~5 months from application to passport.

Spouse received citizenship in 2019

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Sorry about your situation.  I agree with most of the other responses that this should not be an issue naturalizing under the 5 year rule.  When he threatens to contact USCIS tell him he is opening himself up to an immigration fraud investigation.  I know that is tough when dealing with a verbally abusive ex-spouse, and I am not suggesting you engage with him more than you have to.

Even a 2 year GC as divorce waivers with the I751 are fairly common.  We all know the ROC process is just a way for USCIS to get more money.

I told him he can’t do that because I stayed with you for 10 years and had 2 kids together.

that does prove that the marriage was legit and real.

I already protected my self and my kids by getting a place for us and we are safe now.

 

Happy u are away from him but u can report further abuse ( if he phones or texts or emails)  to local police and ask for a restraining order

He does get to see his children but a court can make an order that allows him visitation (sometimes thru social services)

Salam Khadija and Ramadan kareem. Please, be assured everything will be ok. You got the strongest evidence that your marriage was real. You had kids toghether. Threathning to report you to th immigration is considered an emotional abuse. I wish you the best.
