I864 asking for latest tax return document

In 23.a of form I-864, it asks "Have you filed a federal income tax return for each of the three most recent tax years?" and in the Note it says "You MUST attach a photocopy or transcript of your Federal income tax return for only the most recent tax year." I have two questions.

1) I have filed tax returns for all 3 past years including 2022 but I don't see the transcript available in the irs website yet. It says it may take 3-4 weeks to get it and I dont want to wait that long. Would it be okay to just submit tax returns for 2019, 2020 and 2021? Or should I submit form 1040 for 2022? Or am I allowed to later upload 2022 tax transcript when it becomes available?

2) When I login to IRS website, it gives me 4 options to download transcripts which are Return transcript, Record of account transcript, Account transcript and Wage and income transcript. Which is the one that they want me to upload? Or is it 1040?

Thanks

1.  If you can't wait, submit a copy of the complete filed 1040 package (including schedules, W-2s, 1099s) for tax year 2022 instead of a transcript.

2.  Return Transcript.

Note:  My transcript was available in a week or so.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I could be mistaken. Could have been a couple weeks or so.  I also filed thru my CPA.

  • Until April 15th and after 2021 is the most recent
  • you can provide the 2022 on CEAC by updating it after it is processed and/or at interview

Op has already filed 2022 taxes.  Thus, 2022 is most recent tax year filed.  That's the one I would use.

I sent my 2022 tax return + W2. Then I wrote a letter explaining why I don't have the transcript yet (we filed by paper since my husband doesn't have a SSN or ITIN). I printed it, signed it and uploaded it along with everything. We got DQed in 16 days.
