How did the story change? 
 

she’s divorced, I just never said when it happened

 

Mom, ex husband, and daughter come to USA and overstay B2 visa.

 

ex husband decided he’s going back to Brazil mother and daughter stay in USA. 
 

mother gets married to USC 2 years ago might be 3 by the time they even have an interview. 
 

they get married before daughter was 18. 
 

 

will ask if it’s 10K total or 10k each as I’m not sure. 
 

like I said I’m just trying to get all the information to share with them so they don’t get taken advantage off is all.

Yea this is what I need to find out if it includes the USCIS fees I agree totally fair price. 
 

they made it seem was 10k each, but I’ll clarify with them!

Lawyers generally charge $5000 (excluding USCIS fees) for one I-130 (this does not include adjustment the I-485 etc).

$10, 000  for one or even two isn't that bad... especially as there is an overstay. 

Have they asked if the $10K includes interview prep and joining them at the interview (I would assume with this very peculiar case an interview will happen). 

 

Talk to the lawyers again and ask what is included. 

I agree with others when they state, your friends should not be filing without a lawyer.

Timeline

After 4 years of overstay for the family (mom, dad, daughter), mom and dad get a divorce, dad scampers off and mom conveniently marries a USC before the daughter turns 18.  Mom's date of becoming a USC will probably be close to when the 10 year bar for ex husband will expire.  Then perhaps another convenient divorce and remarriage.

 

The above cynical scenario is what will probably go through the head of the USCIS case officer who reviews their files.  It will be up to the mom, daughter and lawyer to convince USCIS otherwise.  Hence, the need for a good lawyer.
