No state government has the right or ability to confirm whether any marriage has been sexually consummated.   Therefore, that cannot be a parameter for a legal marriage.

Could you imagine, fine line between revenge porn, and "proof of sexual consummation"?  What about asexual people marrying each other, forced sex, or else?

For immigration purposes, it always has been "to be physically in the presence of each other".

Shocking.

I can't even imagine: the agent reviewing evidence and stumbling upon pictures of that nature.

This would no doubt lead to claims by persons on two different continents that their internet wedding, was subsequently consummated online.  Which they have chat logs and screen captures to conclusively prove.

Forcing myself to stay on topic ..and not get lost down @Lemonslicerabbit hole…
Marriage in prison is easy, they let anyone get married. .and USCIS can only bar for crimes against children.

Married in Prison

Charles Manson might soon join Ted Bundy, Richard Ramirez, the Menendez brothers, and other notorious killers in tying the knot while behind bars

There's a reason the instructions now state not to send explicit pictures, sexy times, or baby delivery... 😆

Again, the same principle applies here - don't volunteer information unless asked

Jokes aside, yes only send decent photos, preferably not just selfies, but from events with friends and relatives.

@Melissa1711 you may have some evidence of visitations arranged etc. I don't have experience but can imagine you have to deal with approvals from facility etc. Perhaps these could be used as evidence of bonafide relationship?

Yes for sure.. I had to submit ID and waited 9 weeks for background checks then was approved and on his visiting list I mean all I have is our endless call logs consistent video visits and my in person visits as often as I can my last visit was there for his birthday I’ve got screenshots to show

I speak to his family a lot too but other than that that’s all I have to show proof

No issues with getting married on ESTA (or tourist visa) then leaving again.
Several members on VJ have done it successfully (myself included).
It is also possible to visit after you’ve married a USC with or without a pending I-130.
But, each entry is at the discretion of CBP.

if you’ve had several successful trips to the US and always returned home I don’t see you having any issues but of course you might be denied entry…

The one problem you might have with being sponsored by your partner is the affidavit of support… you will probably have to get a joint sponsor when you do go through with the spousal visa process.

You can search visajourney for other stories of people being sponsored by their partner in prison.

I have his family that would be my affidavit of support but would I need to reside with them? Where it would ask about address I would be living at I wouldn’t have one as I would be back home in uk pending the I-130

that but confuses me as I thought if I got approved I would get us a place to live to get it all sorted for parole to approve his release but I can’t do that until I become a resident and approved?
