Her going home, then I guess he has to see if he prefers to be a single dad to a newborn, or to rarely see his child.  Sad to see that with all the red flags they decided to get pregnant 😕

Agree but we are where we are.

She should have held out for the GC and for him to adopt her children

Don’t be a sucker. Inasmuch as you’ve developed bonds with them, you would have no legal basis to keep them and the longer you stay with her before pulling the plug, the more locus she would have in demanding support from you for all the kids.

Pull her affidavit of support, you will thank us later for the advice. This relationship apparently was a train wreck ab initio!

Just another random guy from the internet with an opinion, although usually backed by data!

Getting information from other Filipinas or new flame.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Without a U.S. passport?

Obviously not.   And perhaps it was not clear, but I meant via a legal custody arrangement via the courts.

i dont know about PH, but in Indonesia, a child can have dual citizenship/passport until 21 yo and then have to choose one.

in 2018 my friend got custody battle with her husband. both of wife & husband overstay their visa for 20 years, dont have any status in USA. they are married with 2 kids. both kids born in US and are US citizen. they have 2 passport ( USA and Indonesia ) because they are not 21 yet. she asked the judge to hold his passport, and the judge did. u know what happened? the husband took their kids back to Indonesia. how? he just reported that his passport is  "missing/stolen" to indonesian consulate in NY and the consulate give travel document to him without question.  obviously the mother is flabbergasted.

so is it legal? of course not. but can it happened? it did happen. guess OP have to cover all ground just in case

Just a thought for the future, as you decide how to proceed:

If the baby does not yet have a US passport, but you think there is a chance she will try to get the baby one and leave the country, you should enroll the baby in the State Department's passport issuance alert program.  Once you do so, a US passport cannot be issued without you being notified and confirm you agreement to its issuance.  For details on how the program works, take a look at:

https://travel.state.gov/content/travel/en/International-Parental-Child-Abduction/prevention/passport-issuance-alert-program.html

Has the baby's birth been registered with the Phillipine Embassy or Consulate?  If so, i don't know if there is a similar program for issuance of a Phillipine passport.

The baby's birth has not been registered neither does the baby have a passport

Baby was born in the US. But from what I have read, because her mother was still technically a Filipino citizen, the baby would have dual citizenship.

And the baby has a U.S. birth certificate?
