So we filed for AOS in May and received our Biometrics letter June 4th for the appointment on June 21st. On June 16th we received an RFE (40) for income tax paperwork. Quickly sent that back in and it was received June 28th. We had a successful Biometrics on June 21st.

We then received our Interview notice on July 19th for an interview date of September 13th. We are K1 Visa. Jennie had full medical in the Phils at St. Lukes before coming here in February. She had vaccinations except for Tetanus and Rubella. I think that is what it was.

We applied for only AOS (I-485), not Employment (I-765) or Travel (I-131). We did not see a civil surgeon or complete the tetanus vaccination before filing AOS and did not receive an RFE for medical.

Our AOS interview notice has a huge list of what to prepare and bring to the interview. It asks for civil surgeon and vaccination supplement.

Jennie is pregnant and in her second trimester. The docs says she cant have the tetanus shot because she is pregnant. She has had multiple visits to the OB/GYN and had many tests done.

And as Willie Revillame would say: QUESTION!!!!

Ok fine. Here's my question:

Do we still need to see a civil surgeon and/or do something with the vaccination supplement? Do we need something from the OB/GYN or can we just bring the docs from St. Lukes?

Thank you.

You still need to see a CS. The CS will have authority to waive any and all necessary vaccinations if medical conditions warrant it. Your wife being pregnant is a valid medical condition which would allow for a waiver, but that waiver needs to be approved by the CS, not your OB/GYN. Go see a CS.

Alternatively, you can just show up at the interview without it and try to convince the IO, but he or she may not empathize with your explanation and may request an additional RFE before you're finally approved.

It's up to you if you want to take the risk of a possible RFE.

Your wife was supposed to see a Civil Surgeon (to get the tetanus, when pregnant, she would not get the shot) and even if medical exam is not needed, she was supposed to present to the CS doctor the St. Luke's vaccination sheet so the doctor can tranfer them to the I-693A supplemental form in a sealed envelope. You were supposed to send the supplemental form with the AOS package. Many applicants were approved without interviews because all docs & evidences were there. If your wife had went and obtain the supplemental form, probably she would've gotten approved without an interview. Then again, probably not.

She needs to see the Civil Surgeon right away and get it squared away and bring it to the interview.
