Hey fellow VJers,

I (CR1 via I-130) am planning to file my N-400 under the 3-year rule. At this time I have now filed (MFJ) and received three tax transcripts (2020, 2021, 2022).

Would these tax transcripts for the years I filed be sufficient to be able file my N-400 application or, given it is still tax filing season would I be expected to provide evidence of filing in 2019? I did not file in 2019 as I was living abroad prior to moving to the US. 

 

If my tax transcripts are sufficient, I’d love to file the N-400 just after hitting my 3 years in the US, but of course willing to wait a little longer to get the timing right! 

 

For reference, here are my key dates since arriving in the US:

Entry: 3/20/2020

Filed I-751: 1/6/2022

I-751 NOA1: 1/12/2022

Trip abroad to U.K.: 2/15/2023-2/26/2023

1. Were you an LPR at any time in 2019?

 

2. Were you a resident alien for IRS purposes at any time in 2019?

I was not an LPR during 2019.

 

I was not considered a resident alien at any time during 2019. My spouse filed 2019 taxes MFS with myself considered as nonresident for tax purposes.

Then you meet the requirements for good moral character with respect to tax filing.
