helloo,

I asked a similar question udner CR-1 section earlier, but this one is more related to AOS proc. Basically, my wife's interview is on August 23 , 2007 for K3 visa. Now yesterday, I got some papers from NVC (AOS fee bill + choice of agent for CR-1). Somehow, ( I did not file I-824) my I-130 got forwarded to NVC and also assigned a new case number. Now when my wife comes to US on a K3, can we do AOS if the I-130 is at NVC and has case number assigned..?? does this happen to everyone..?? for AOS does it matter if I-130 sitting at USCIS vs I-130 sitting at NVC with a case number..??

I am really confused at this point. can anyone shed some light here please..??

07/31/2011 -- US Citizen wife applied for her parents I-130

12/12/2011 -- Got NOA1 ONLY for mom's file

01/17/2007 -- I-130 packet sent to NSC

01/27/2007 -- moved to CSC

01/29/2007 -- NOA1 received

04/19/2007 -- NOA2 received

K3 -- I129F

2/12/2007 -- packet sent

2/22/2007 -- NOA 1

4/25/2007 -- notice received in mail

5/10/2007 -- NVC recieved case (finally, after 3 weeks)

5/14/2007 -- NVC sent case to Mumbai embassy

5/21/2007 -- Embassy received case

5/31/2007 -- wife sent in packet 3

6/15/2007 -- wife received packet 4

8/23/2007 -- INTERVIEW DATE wohooooo + got K3 visa on 23rd :)

9/03/2007 -- sweetheart is here in US

AOS - EAD

9/17/2007 -- AOS/EAD package sent to chicago lock box

9/26/2007 -- NOA 1s for 485 & EAD

10/1/2007 -- biometrics appt letter received

10/13/2007 -- fingerprinting....speed it up guys..

11/28/2007 -- card production ordered - EAD

03/04/2008 -- final interview for greeen card :)

This is normal process for K-3,

The K-3 allows you 2 options, either keep the CR-1 (I-130) in process, and either travel back to home country to interview for the immigrant visa, or just hold the K-3 visa and wait out the CR-1 visa in the home country, one member here did that, their CR-1 interview was scheduled a few errks after the K-3. They save a lot of $$ doing that in the foreign country than here.

Other option is to abandon the CR-1 visa process and adjust status from K-3 in the USA, Fee after July 29th will be $1010 to adjust status.

Continuing the CR-1 and entering the USA using the CR-1 can be much less expensive option.

This is normal process for K-3,

The K-3 allows you 2 options, either keep the CR-1 (I-130) in process, and either travel back to home country to interview for the immigrant visa, or just hold the K-3 visa and wait out the CR-1 visa in the home country, one member here did that, their CR-1 interview was scheduled a few errks after the K-3. They save a lot of $$ doing that in the foreign country than here.

Other option is to abandon the CR-1 visa process and adjust status from K-3 in the USA, Fee after July 29th will be $1010 to adjust status.

Continuing the CR-1 and entering the USA using the CR-1 can be much less expensive option.

thnx for the clarificatio. :)..so basically everybody who is doing AOS, have their I-130 held at NVC (witha case umber assigned?) thank for the reply.

Typically USCIS will recall I-130 from NVC when AOS is applied for.
