I'm divorcing my US citizen husband and idk what to do

Hello all,

 

My husband and I have been married for 4 years. We went through the spousal visa process (my category was IR-1).

I got to the states a year ago and he's been cheating on me, insulting me, yelling at me, he's been even aggressive and would throw stuff at me... I work and contribute with the bills and groceries and also take care of mine and my baby's personal items. I really don't make much money but I make it work while he has a really good salary but still demands me to " split" the bills which I don't have a problem but I have no money left and so I haven't even be able to get a car..

 

Now the thing is that the situation is really bad, he is always threatening me about divorcing me and taking my child away (even though he is never around her). He even said that in order to not to give me child support he would stop working. I don't care about money because I know how to work but I want my baby with me... 

 

What do I do? where do I start? Any advise would be appreciated. Thank you.

children are very rarely separated from mother and given to father

 

BTW  he can't have u deported either

Stay safe and come back to VJ if you have questions - lot of great people to direct you to more local resources if you need.

Thank you. I will do everything y’all advised. Good thing is my GC and passport are out of this house.  I will do a deeper research towards the custody of my child since he says I would lose cause I make less money but honestly, he doesn’t even know my child nor takes care of her other than providing a roof.

This is all manipulation, do not let him determine your fate.

 

Only court can decide who will have the custody over the child, if you're going that route.

 

It's hard, but try not to engage in heated discussions with him. This leads to emotional or physical violence sometimes. Stay calm and focused. You deserve better treatment.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

 Very hard for a man to wrest children from their mother especially in Texas. The woman would have to be a total incompetent to lose her kids to a man!


4 years, 11 months, 2 weeks and 3 days

Citizenship Complete!
