Hey everyone,  I need feedback for my I-751 cover letter below, i need to submit my ROC package by mid of April-23. 

please let me know if any suggestion or correction.  Thanks in advance

I am filing a joint Form I-751, Petition to Remove Conditions on Residence, with my wife/husband, Name(A-123456789). My Wife/husband entered the United States under K1/B2 visa on April 35, 2019, and we got married on Aug 17, 2019. He received his Conditional Permanent Resident card on Sep 28, 2021. We have remained married and living together.

 

We respectfully request that this petition be accepted for removal of conditions on residence for my Wife/husband Name.

 

We are enclosing the following documents to verify the status of our marriage and ongoing relationship:

 

Evidences of our bonafide relationship:

  • Copy of our Marriage Certificate
  • Copies of our joint IRS tax return transcript for 2020, 2021 and 2022
  • Copies of our W-2 2021 and 2022 showing proof of same address
  • Copies of our 3 months statements of our joint bank accounts at Citi Bank
  • Copies of our 2 months statements of our joint bank accounts at Bank of America
  • Copies of joint Apartment Lease contract from previous and current apartments
  • Copy of our Storage Unit contract showing our names and same address
  • Copy of our utility bill showing joint account (DTE/Consumer Energy)
  • Copy of our health insurance policy showing a joint policy
  • Copy of our Car Insurance joint policy showing our names and same address
  • Two original notarized affidavits from family and friends as proof of our bonafide marriage.
  • Pictures together from 2019 to 2023

 

Copies of documents submitted are exact photocopies of unaltered documents and I agree to submit original documents to an Immigration Officer if required.

 

Pursuant to 8 CFR §216.4(b)(1) and in consideration of the enclosed evidence we respectfully request that the interview requirement be waived.

 

I appreciate your prompt attention to this matter and respectfully request your favorable adjudication of this petition. Please do not hesitate to contact us with any questions or concerns.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

No cover-letter is needed at all.  Seriously.  Ours was as follows:

I was sure to write "Original I-751" on the mailing-label of the envelope that contained the package.

You don't need W-2s and Transcript. Do the latter. 

 

I would remove that CFR paragraph. You cannot tell USCIS what to do or direct their process. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I see. I wouldn’t include it. I think it can backfire you in the sense that officer can think “I wonder why they don’t want an interview, are there any red flags?” And make it worse. I hope it makes sense. Also the passport bio page is not necessary. You’re way past the identity verification stage.

I’d also send quarterly bank statements.

They want to see evidence/documents since the time of marriage until the date of filing.  I suggest that you submit quarterly bank statements since you got married or opened the account.  Also include more evidence since your marriage date, not only the most recent joint utility bills.
