Timeline

Hey folks,

I'm putti8ng together my updated I-864 for Almira's AOS interview, which is in a month. I had a quick question about part 4, section C, which asks me to check one of the boxes about filing taxes this past year:

1. I filed a single/separate tax return

2. I filed jointly, which only includes only my income

3. I filed jointly, which includes income for both my spouse and myself.

My question is this: We filed jointly (Almira claimed resident status for tax purposes), and so we included her foreign income on 1040 line 7, but we excluded it all in line 21 (we took the foreign earned income exclusion), and so only my income is reflected in line 22 for the total unadjusted icome. So, which box do I check in the I-864, 2 or 3?

Sept 3 - *** WE GOT MARRIED!!! ***

Oct 24 - Sent AOS, AP, EAD

Nov 7 - Receivd NOAs in the mail

Nov 7, 10 (checks cashed), 19 - "Touched"

--2006--

Jan 3 - EAD app "Touched"

Jan 11 - AP approved!

Feb 6 - Received biometrics appointment letter

Feb 23 - Biometrics taken

Feb 25 - AOS and EAD apps "Touched"

Mar 1 - EAD approved!

Mar 4 - EAC arrives in mail

Mar 7 - Receive AOS interview appointment letter

May 2 - AOS interview; received "Welcome to the US" e-mail notification later that evening

May 12 - Green Card arrives in mail!

I would say 3, because like the deductions and credits (etc blah blah) that you might apply to yourself if you were doing the itemised thing on the tax return, you did include her income, but then took it all off using the 2555, right?

I'd tick the number 3 box. Don't know if any other have any other suggestions. :)(F)

3/29/06 - AOS Approved!

3/3/08 - Check cashed for ROC at CSC...

Feb 2009 - Called USCIS to see what the heck was goin' on...

FEB 20th 2009 - Received email - GC on the way!

I am APPROVED for the 10 year PR Card!
