Initiate AOS for beneficiary out of the country?

Hey mod, you can close this thread. I am very grateful that I don't have to deal with the I-485 until my wife is ready to adjust. 

And the lightbulb goes off for me. We will have the I-130/I-485 combination when that time comes. DUH!

Huh?

 

I don’t think you’re getting many of the critical parts to this.

 

Your wife cannot enter the US with the intention to adjust.

 

You need to petition her for an immigrant visa.   I-485 will not be part of the process.

Timeline

To review. My wife is in the country with her 2 year GC. Per my profile.

For a variety of reasons, my friends have not completed the GC process.

She competes internationally. He was pretty hot in his sport in his prime.

As mentioned, it is a complicated relationship. 

They asked me to help them through the I-130 process.

She does not want to stay in the USA for the entire period on an AOS.

This group has been very helpful helping me to understand that they should work the I-130 through to its normal completion.

And that is what they will do (I hope).

Sorry that I was less than totally clear through this thread.

Now can we put a lid on it?

Wait, if your wife is already in the US with a green card, why did you say that your wife will be ready to adjust in the future? 
Are you sure you understand how adjustment of status works?


Are you sure you understand how a CR1 works? 
Are you sure you understand how a K1 works? 
 

Do you understand that coming to the US with a B1/B2 visa and with the preconceived intention to adjust is committing fraud?

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
