Hi guys I am USC filing for my spouse, I decided to file I-864EZ is because she is my only sponsor and I meet the income requirements. However, the form automatically generates "2" household members (see below image) and if I add my spouse, it will be 3 - which would be incorrect...? Should I just leave it as 2? 

 

Another thing, I the petitioner was divorced few years back - I read somewhere that I have to provide this information again during the NVC stage too.. I don't think I am supposed to upload that in affidavit of support under the "Other" documents (where it shows a long list of documents to upload like proof of USC etc - everything that I already submitted to with my I130...). Or am I supposed to upload all this again?

If your spouse is the beneficiary, then they are already counted under item 1.a.  Leave 1.b blank as the form says "Do not count any household member more than once."

Upload petitioner's divorce decree(s) under the additional documents section on the Civil Documents tab.  Label the file(s) as petitioner's marriage termination document.

I haven't go to the civil documents part yet - assuming that comes after submitting DS460. I thought civil documents was mostly just information about my wife who I am sponsoring.

Do I need to submit my US passport, divorce decree, birth certificate in the affidavit of support again? I submitted those in I-130. Or would those go in civil documents. Confused why those are listed here

 I-130 was for USCIS.  NVC is Department of State.  Different agencies so much has to be resubmitted.   You should provide proof of US Citizenship like passport or birth certificate and proof of US domicile like a drivers licence or utility bill or something with your US address to establish that you are eligible to be a sponsor.  So those are financial documents.  Your divorce decree is a civil document necessary to prove your spouses marriage to you is valid.

No I didn't, she was a us born citizen

At NVC, there are 2 sections:

 

AOS - this is where the petitioner submits the I-864 and supporting documents for that form.

 

IV - this is where the visa applicant (the petitioner's beneficiary) fills out the DS-260 and uploads civil documents (photo, passport, marriage cert, divorce cert, birth cert, police cert, etc).

I understand that they are different agencies, my question is am I supposed to provide my (the petitioner's) proof of USC, divorce decree etc in the AOS section? Nothing in the I-864 mentions that at all beside it just being financial document. The only reason I asked this question is when I click on, upload other files - it gives me above options to assign the file as...

On page one of the I-864 form itself it says.

 

"NOTE: If you are filing this form as a sponsor, you must include proof of your U.S. citizenship, U.S. national status, or lawful permanent resident status."

 

So proof of US Citizenship is a required AOS document, as is proof of US domicile and proof of current income or employment.

 

Divorce decree is not part of the AOS.  It is a civil document that is required to prove your spouses marriage to you is valid.  It goes in Civil Documents.
