I've been reading on this forum on how it's much better for spouse to be approved on the I-130 instead of the I-129F...MY I-130 is at 17xxx & the I-129F is at 18xxx.....

So it looks like the I-130 will come along first but what if the I-129F jumps ahead(that's why most of us filed that one so our loved ones could travel faster) but 1 to 2 month difference is no big deal considering the inconvenience & expense the I-129F will bring....

Would I be able to cancel the I-129F in case it does jump ahead and just wait for the I-130 to come thru???

Or does dthis sound crazy??????

I dont know but my I130 was filed first and according to my timeline, has skyrocketed ahead into 2008. I am glad I did the 129f and in all honesty, I think the 129fs will move alot faster than the I130s come the fall due to an influx of filings and the raising of the AOS fees

When both cases are at the Consulate and an inteview is scheduled for a K3 visa, the CR1 interview is supposed to take the date. They are not allowed to issue a K3 visa when an immigrant visa is immediately available. There is a State Dept. cable that defines "immediately available" in this context as "The I-130 is on station." The D R has some strange procedures though so they may not follow the same procedures many other Consulates do in this matter.

It might be worth a concise email to the Consulate to ask about their procedure when both cases are on station.

Facts are cheap...knowing how to use them is precious...

You may want to also send a PM to twincactus because he knows a lot about immigration to the DR and has a bit of an inside scoop on things in the consulate down there.

I would not cancel either petition. I would leave both on the list and most likely you will probably be married two years by the time your interview comes so you'll automatically get the IR1 anyway. I think they automatically do that now days down there. But Tim should be able to tell you better because he's been at it longer and has already gone through the process where as I'm just getting started.

Sent I-130: 07/19/07 (Priority Mail/Return receipt)

NOA1 Received: 08/04/07 (NOA dated 07/31/07)

NOA2 Approved: 10/25/07

Sent I-129F: 08/06/07 (Express overnight mail)

NOA1 Received: 08/20/07 (NOA dated 08/15/07)
