FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

I have read your multiple call history with various reps. You were patient and even managed to get bits of useful info. 


I can only stress ( 3rd time): You need to get Congressional Liason involved now and stress the fact that USCIS has been unresponsive and the matter is extremely urgent. You are asking them for help with

1. Reopening of I-751 ( lack of notice )and interview schedule ASAP 

2. Re opening  of N-400 ( which was denied because I-751 deemed abandoned)

 

******Do stress both denials were /are Service Errors  and your “ service request” was made in person at the N-400 interview w promise of supervisor review ….but you are now caught in “ wait in line for 30 day” loop of phone reps. *****

 

 

 

Getting an InfoPass appointment takes a special “set of skills “, apparently there are only certain reasons they consider urgent/valid..give it your best shot.
 

And put that $20K in your pocket…you can do this. !!!

Ok, I see what you're saying. Yep, agree... OP still did not get the denial notice, but USCIS can see it on their end. I see.

I wouldn’t refile anything until you know why she was denied. To me, it’s not very usual that they deny the N400 just because the 751 is pending

Reading the pdf of the n400 denial it says that the i751 was denied because she didn't show up for the interview hence the n400 denial.  Is it possible to refile the i751 after this amount of time since our marriage?

Excellent,  excellent advice. If I may just add something, keep an Excel spreadsheet where you keep track of all the efforts you've made with as much detail as possible.

I see. I am so sorry you're dealing with this BS through no fault of your own. 

My experience in VJ tells me you'll get two types of advice. Fight to reopen the denied 751, through the Congressman etc etc or refile. I'd just go with the one that implies less hassle, which is to refile. And going back to your question, yes, you can refile. You'll actually have more evidence of your relationship. That's what I would do. 

 

If you do decide to give it a shot to reopening BOTH the 751 and the N400, I would definitely get your Congressman involved. I would also start an Excel spreadsheet with details of any interactions that you've had with whomever to try and solve this issue. The issue is that they usually reopen a case when it was their mistake, but in this case it was your mistake because you put the address wrong if I am understanding correctly. Therefore, I think reopening might be a waste of time.

Just curious and based on your knowledge, since this was apparently due to an error on OP when filing the change of address, would USCIS still honor the reopening? It wasn't their mistake. This is what OP said:

The latest tier 1 stated that the problem was when I put the address change in I put the wrong previous address but the correct current address.  She stated the previous address has to be the address where I filed the form at first.

No matter what error was on AR-11 …it is not OP’s fault….on top of that being gibberish and what that rep considered “educated guess” .

IT IS SERVICE ERROR, can be re opened if OP acts.

I would not bank on anything coming from a Tier1, and AR-11's are messed up all the time by USCIS.

Yes. In fact under the law  a Conditional LPR is at risk of heading to removal proceedings until a new  I-751  is filed.  Current official USCIS and ICE policy per the Secretary of DHS is that should not happen.  But never trust a DHS officer to follow a memo.  
 

The  AR-11 wasn’t filed correctly. Unless you received notice acknowledging the address change, I don’t see a path for appealing I-751.

They are messed up all the time.

 

This thread suggests to me that perhaps a large reason why they are messed up is the beneficiary  messes up the “previous address” section of AR-11.  
 

My wife was a serial AR-11 filer during our transient phase between California and Arizona this past summer.  I wondered why form  was so particular about the “previous address” and now I understand why.
