Just file the N-336 before the 30 days. State denial in error because the I-751 was never “denied/closed” and Lacked Notice for both Interview and any decision…up until the the actual N-400 interview date when the only status was a purported “ red flag” as told by the ISO. 

 

You will win. 
 

IF they actually schedule an I-751 interview before the 30 days ( super unlikely ) you will need to INSIST on getting an ON THE SPOT decision/review from N-400 Supervisor.

For money reasons filing the n336 may not be possible.  Is it possible to refile and get an n400 approved  after the first was a denial?

That would be penny wise, pound foolish…since the difference between the two is $20…

 

I know you are once again beginning to doubt..but do recall that when you were ready to refile ur I-751 ( at others insistence and fear/ uncertainty)..you took a step back and things worked out. 
 

My position and recommendation is the same. ..on refilling for both: NO. 
 

I have tried at LEAST six times to get you to lodge a service request specific to the N-400..either by phone , letter or get and InfoPass or bug the congressman..but you avoid responding if you have tried those. Those are the FREE versions of what we accomplished w the I-751 ..( no different).

 

But the decision is yours, a poor one if you decide to refile.

We will file an n336 most likely.  The tier 2 said she can't request another interview for the n400.  But I will file a service request specifically about the n400.

Good for you. Remember it was “ them”/ USCIS that in black and white said denial was because I-751 had been “denied” , yet there was NEVER a Notice of such . ..and you are NOT expected to read their minds, when even repeated inquiries ( in person and on phone could never give you a definitive response to status of I-751) 

so you get a chance to battle it out…and because it’s Service Error, the odds are greatly in your favor.

 

Think of this as saving $10k in legal fees ( although @Mike E valued it around $20 K …Lol) and pat yourself on the back.


If you think you qualify for a fee waiver I-912 , then by all means go for it , they just take a long time to review and decide the fee waiver, but worth the effort if you income is within guidelines

I don't know why our case would require legal representation from a lawyer but we intend on filing an appeal for the n400 as well.

After receiving the foia on the i751 it has a denial stamp may 7 2021.  

 

Why is everyone at the uscis tier 1 and 2 stating it wasn't denied yet? And why would it be in pre schedule phase after requesting a reschedule and the request being completed? Including no online notice of a denial. The n400 denial is on the uscis account but the i751 isn't. 

 

Very strange.

According to the recent talk with uscis the i751 wasn't closed, it went into denial because of the no show to the Interview.  From then it went into a hold then the service request to have it rescheduled kicked it out of hold status and back into rescheduling phase. The uscis notifications on the i751 state that the request for reschedule is completed. According to the uscis their is no time frame for reschedule.

If it's as glitchy as that then what legal basis would uscis have to do anything at all? Lol.

The tier 2 also stated that the i751 was in the process of being rescheduled. Tier 2 also said it wasn't closed or denied and she said it was.already sent.to be rescheduled.

 

If nobody at the uscis can know or needs to know anything then basically I can work their and get paid to do nothing lol

You'd be surprised that some members of this forum, especially the most "seasoned" ones, know way more about immigration than some of their agents.

What legal basis would the uscis have if multiple agents can be wrong or dont know and the website also not give out correct information on a case status?? I agree that any one or organization can be wrong but what you are saying in my case is that ALL of the online notifications and emails and all the officers I have talked to are wrong.
