Yesterday she got scheduled an infopass appointment for next week.  The service request to find out why its taking so long to get an roc interview also stated that they will discuss that at the infopass appointment.

Hopefully you go w her so she does not end up with a perfunctory “ we are working on it”. ..

What has congressional Liason emailed you?
Has ombudsman responded to your email/complaint ?
Have you filed N-336 ?
Is she ready to articulate her urgent need to expedite ( based on their criteria)?

  • 2 weeks later...

The officer told my wife that it's denied, when my wife asked about why multiple uscis and online states pending the officer said pending means its on its way to a judge to begin court proceedings.

Is there a way to find out what is being sent to a judge??

@IandI100 I think your case is moving towards your wife being placed in removal proceedings. Hire a lawyer to challenge the decision (which the FOIA letter says it's impossible) or file new I-751 with help of a good lawyer. Even if you guys file new I-751, the gap between May 7th 2021 (the date I-751 denied) and today (December 20th, 2022) already can cause a lot of confusion in the future at I-751 and new N-400 stages. E.g. I wouldn't be surprised if USCIS will reset the wife's clock for naturalization.

This is not a DIY in my opinion.

I'm sorry this is how your case turned out to be OP. Unfortunately seems like what was said in this thread was true - agents didn't know much/made mistakes and now your wife has been accruing unlawful presence since May 2021. I don't have advice for you besides the quote from OldUser above. Please consult a lawyer asap!

I don't believe she's accruing any unlawful presense. She's LPR until put in removal and judge rules out to take the status away.

But I still suggest consulting with lawyer at this point and probably filing a fresh I-751.

File a new I-751 TODAY…unless the NTA is properly served it’s won’t be an issue. ..and they did not serve her when she went there..so you are in time.

I’m sorry you are in this situation, but it doesn’t come as a surprise to me. We warned you that when they said it was “pending”, they didn’t really know what they were talking about.
File a new 751 with updated evidence TODAY, and include an I-129b. With your filing include a letter with a timeline that explains how/ why you got to this point.

The i751 will be a few years late, can that even be processed?

Yes. And to further your chances you’ll file the i-129b

Did you tell your mom? What does she say?
