Entering with children

My children and I are planning to activate our immigrant visas by going to US by air, during March break. Our petitioner (my spouse/ their father) is already living and working in the US. We also have a house that we bought there where we will live. We are planning to come to Canada after March break for the children to finish up the school year and then return to the US with all of our belongings at the start of summer. Would that be an issue if explained at the POE?

Why would you explain it? Best to just answer questions asked

You are activating your Immigrant Visas in advance of the big move, quite common.

not an issue. You have 10 years to import personal effects and household goods Your situation is common. How long you stay isn't an issue with incoming

Be aware that after you activate your US PR status, you are likely to lose Canadian health care benefits, depending on which province you live in and will have residency tax implications.  The expectation is when you are a permanent resident of the US, you reside in the US.  

 

If you're ok with this and the implications, no issues.

The OP cannot meet all the requirements. Once the visa is endorsed she claims the US as her primary resident. You cannot have a primary resident in both places. Also by claiming to be a Canadian resident is one rabbit hole she does not want to go down, it's a good way to lose her US PR. Her date that she stops being an Ontario resident will also be on her exit taxes. 

 

It is also wise to not encourage someone to use OHIP when it won't be you that has to pay OHIP back. 

Who qualifies

With certain exceptions, to qualify for OHIP, you must meet all of the minimum qualifications listed below plus at least one of the additional requirements.

To meet the minimum qualifications you must:

  • be physically in Ontario for 153 days in any 12‑month period
  • be physically in Ontario for at least 153 days of the first 183 days immediately after you began living in the province
  • make Ontario your primary residence

Adding additional info

 

Once you enter the US as a PR make sure you stop what ever they are calling the baby bonus and GST checks if you receive them. If it is check form, return to sender it. If direct deposit get that stopped fast. They are the worse with continuing to send payments even after you cancel it. Then they turn around and want all their money back ASAP.
