I am currently in the process of filing my affidavit of support. The form requires you submit a tax transcript which I have no issues with. 
 

My question is: I had last year’s taxes filed by a tax preparer with HR Block and they filed it with the filing status of ‘single’ instead of married filing separately due to the fact that my spouse was a non resident alien who lived overseas. Would this pose any problem when filing this form and has anyone had a similar experience? I have also ran into issues with e-file submissions where they do not allowed me to file without a ITIN or SS number which my spouse does not have. 

 

Note: I normally file taxes on my own but paid someone to do it for me because of the fact that my marital status changed as well as I purchased property, which made it more complex than the previous years.

You will likely get a variety of responses to your question ..

 

technically you should have filed MFS   .,   so submitting an amended return is the correct action .,

 

however, many vjers feel that the actual filing status error is one that wont cause issues .. that the most important thing is that you filed a return , not that you filed it correctly. 
 

its going to be a judgement call you will need to make.. depending on your level of comfort ..

Be aware that you filed incorrectly.  You cannot legally file as single if you are married.  This is an IRS issue, not an immigration issue. Personally, I would amend those tax returns after spouse has SSN.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Me too.  This is a non-issue for immigration and because you likely overpaid your taxes compared to what they will be after you amend, it is not an issue for IRS either.  Some members will express their technical, ####### retentive, or moral outrage about it, but it is ultimately NOTHING at all to worry about.

Facts are cheap...knowing how to use them is precious...
