Matt,

How did you address your email to them? You need to supply the information below. As you can see in the email I sent to them. They responded back to my in one day. Try it again with all the proper information. If they dont respond, you can have your fiancee go to the consulate to pick up Packet 3 . But she should only go there if 1 month has passed since they sent it out.

ANOTHER disaster has hit me. Because I am dyslexic, or maybe because I was so panic sctricken and nervous, I put down my fiancee's birth date as being in 2006 instead of 1980! NOW WHAT?!?!?! How could it get this far with such an error.

I am ready to have a heart attack. I am so stressed out over this that I am sich to my stomach. It should not have to be this way. :(

Well, I'm the resident buttinski, so it's your turn. :)

I have followed your posts, I realize how important this is to you, I am aware of the difficulties in using HCMC and I'm aware of the red flags you've identified for yourself. So, I say this with all respect: Dude, breathe!

Clearly the birthdate is an error, and not a fatal one. It will either be returned to you to correct, or be corrected later. Either way, there is nothing you can do about it now. My advice is: deal with what you can deal with, and set aside that which you can't do anything about.

About your financials, it's time to get creative. You're a writer, this should not be hard. I'm a salesperson, so I sold my I-864, and sold it hard. I was unemployed at the time I filed, and I had been unemployed for 2 years. I'd also collected unemployement, and counted that on my affidavit. I was going through a tough Consulate and had just married a man I'd met only months before.

Point: I can paint this in the worst way possible, or the best.

Since he's waiting for his US citizenship at the moment, I'll let you guess how it worked out. :)

This may not be the best venue for you to get your answers. It's certainly not the only one. I encourage you to look further afield, and to read the law and source documents behind all this public charge business (I think you have already done some reading). This is not the case of "a form", there is a concept behind it.

You need to learn how to distinguish good information from bad, and how to be a bit optimistic. :)

For example, I think it's been pointed out to you that not all co-sponsors are created equally, and that you may be conflating some of the 'denials' you've read about (which are not denials, btw) with your own situation. Just as all evidence is not created equal, information is the same. If your co sponsors are your close family members, that is a lot different than your old college roomie who lives 8 states away.

By the by, a sincerely good lawyer, helpful to the DIY community, also happens to practice exclusively with Viet Nam. His name is Marc Ellis, and he posts here as EllisIsland. His posts in the archived forum are gold, and worth looking up. Hiring him for a consultation and a little shoulder rubbing might be the best money you spend in this process.

Because you're after a K visa, you actually have *more* choices of evidence to use than someone filing an I-864.

Employment is not a requirement. Income, or equivilant assets, are.

You are living in "your own" home which is currently titled by your parents. Would you have any equity if you did a private deal back with the parents? Is there anyone else that would cosign a mortgage with you? Another way you can return this asset to your name?

Compensated housing is allowed to be counted under the I-864; have you investigated how you could document your living arrangement?

Can you put a value on the screenplay and count it as an asset? (we're just now getting my dad's first book published and he keeps telling me about the financial legacy he's leaving me ;) )

Finally, all you're battling is time, my friend. Sometimes we can't have our cake and eat it on the same day. If the worst comes to the worst and a visa is not issued, the case is not dead. When you can supply the information they need re: Public Charge issues (like, you've held a job for X period of time), the visa will be issued.

There are a lot of drawbacks to go with the plusses of living an unusual/unconventional lifestyle. Balancing it all out, I wouldn't change anything about what I'm doing, and it sounds like the same for you. The result is that we have to work a little harder when it comes to official issues like these, but I have every confidence that if you stick with it, get some qualified advice (from laypeople and pros) and sell your baby heart out, that you'll succeed and wedding bells will ring this year.

Don't worry about the birthdate. They will search for your case using your case number. I dont think they'll even look at the birthdate. Hopefully, you'll receive a reply with 1 week.
