Correct, some people ARE getting their case numbers as we speak, and they are getting them before the 90 day mark. The rep said BY the 90 day mark. What is untrue in that statement?

I'm trying to find out exactly what state we are in at the moment.

  • May 21st - NVC answers an email saying they have received my case from USCIS and are waiting to process it. This would have occurred sometime after May 9th which is the last time I had messaged them and they said they don't have it.
  • USCIS case status (our old friend https://egov.uscis.gov/casestatus) was checked today for this first time and forever because it used to just say the case was approved. Now it says:

On May 25, 2023, the Department of State sent us your case, Receipt Number WACxxxxxxxx, for review. We are reviewing it, and will notify you by mail when we are done.

  • The current NVC processing times say:

we are working on cases that were received from USCIS on 23-May-23.

 

I don't understand how these pieces of information fit together. Is the USCIS status actually an update from NVC? I guess that makes the most sense, but I find it surprising because I thought NVC and USCIS were pretty separate entities.

That status there on the USCIS case status page means NVC (Department of State) sent your case back to USCIS. NVC found something wrong with it and USCIS needs to correct it. Then USCIS will send your case back to NVC once it's all fixed. Unfortunately the NVC timeframes do not apply to you here because your case was sent back. 

Lawfully tells me your case may be updated to the following statuses.

Yea I called them. the blame it on NVC, nothing they could do. When I asked for a tier 2 agent, they said since it was approved nothing that person could do either. I told them the whole problem is the petition is still at USCIS, more waiting. So i sent a request through askemma. I'll call them again tho

I just called USCIS and after looking into it she said it could be a minimum of 180 days before we get an update now that it has been sent back to USCIS. This news is probably the death nail on this whole process for us... I am shocked right now...

 

The only thing I can guess is that we accidentally submitted a DS-160 too early and that screwed everything up.

I am truly sorry. I was approved less than a month ago and I am hoping it doesn't get sent back too, seems to be happening with a bunch of cases. Sometimes they even get another approval date months after without the status ever updating to case returned. Seems a lot of December 2021 filers are experiencing the same thing. If you're interested, I can send you a FB group specific for returned cases. I would no worry about it being a mistake from your end, it's usually an internal mistake the NVC happened to catch. I hope it's an easy fix and you get to hear good news soon from NVC. Rooting for you and that it doesn't take too long.

What email do they send the mail to ? Is it the lawyer's email address or petitioner's ?

We didn't use a lawyer so it was sent to me since I'm the petitioner.

Below is the email that was sent to me. I took out the my info but I assume you should get something similar.
