I think I had posted this in the wrong forum, so I'm posting it here again....

I sent my I-864 on 8-06 along w/the I-864A from my sponsor(for the I-130).....I read somewhere that this form doesn't expire. is that true? When we go to the interview do the sponsor & myself have to fill out new I-864s & get new employer letters(since the ones submitted will be over a year old)....

The affidavit of support needs to be fairly curent when presented at the interview, they will ask for your 06 returns which were not with the form last August.

Also USCIS has no use for that form when it is attached to a visa petition, it is needed later when NVC requests it from you, and also at the visa interview for CR-1 visa. USCIS probably discarded it if you included it with the I-130 because it is not listed as something needed in the I-130 instructions.

The form does not expire when it is used for the Green-Card either when submitted to NVC and Cunsulate for the CR-1, or for adjustment of status from a non-immigrant to immigrant in the USA (I-485)

Ok I am still confused..........I didn't send it w/the original I-130...I sent it in when the NVC requested it. But it's been a year now & we are still on the waiting list at the Dominican Consulate....

I just wanted to know if it expired after lets say a year or if I could take the same one that I submitted to the NVC, especially for the sponsor, since she lives in another state & it would be a hassle for her to have to fill it out again w/all of her documentatin & than send it to me.

It doesn't expire but having a new one with recent pay stubs and 06 or even 07 tax return is a good idea when the spouse goes to the interview. They may want to verify the sponsorship is still good. Gitterdun!
