I-130 Address Questions

Hi Everyone,

 

Here is my situation:

  • My wife currently lives in London; she is a student and will graduate in May.
  • After she graduates, she will go back to China.
  • On Form I-130, Page 5, Part 4, 11.a-11.h, Beneficiary's Physical Address, I put her current address in the UK.
  • On Page 8, 57.a-58.f, I put her address in China in Chinese.
  • On 62.a-62.c, I stated that she will apply for an immigrant visa abroad at the U.S. Embassy in Guangzhou.

I notice the note in the form:

Choosing a U.S. Embassy or U.S. Consulate outside the country of the beneficiary's last residence does not guarantee that it will accept the beneficiary's case for processing. In these situations, the designated U.S. Embassy or U.S. Consulate has discretion over whether or not to accept the beneficiary's case.

We want to receive the packet at my wife's address in China and have the interview at the U.S. Embassy in Guangzhou since she will be graduating and going back to China soon.

My questions are:

  • Will USCIS use the address I provided in Chinese on pages 8, 57.a-58.f to send the packet to my wife, or will they use the address I provided in Part 4, 11.a-11.h, Beneficiary's Physical Address?
  • If USCIS will use the address provided in Beneficiary's Physical Address, should I change the address to her address in China as her physical address?
  • Or should I send what I have now and inform them of the address change in May by filling AR-11?
  • If I should go with AR-11, will it cause a big delay?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

notification comes to the USC thru USC email/ they no longer send a packet to home address

 

make sure u get the criminal report for her UK stay before she leaves England/  u need this for the NVC stage

Thank you so much for that!!! I only thought of a criminal report for China.

USCIS will not communicate with the foreign spouse at any time during the process.  The first communication to the visa applicant (your wife) will be from the National Visa Center, (Part of Dept. of State, NOT USCIS).  It will be by email.  They will initially assign the case to London, and you'll have to communicate with them requesting its transfer to the "Consulate" (not an Embassy) in Guangzhou.

 

Do nothing with USCIS about her address change.  Deal with this at the NVC stage.

Facts are cheap...knowing how to use them is precious...

Thank you for your comment! Since I stated that she will apply for an immigrant visa abroad at the U.S. Consulate in Guangzhou on 62.a-62.c, is there a chance it will be assigned directly to Guangzhou? I hope the transfer from London to Guangzhou won't add too much time.

Slim chance.  Couple weeks delay is what I've seen.
