Hello Everyone:

I just got approved for my CR1 Visa on Monday January 30th, 2006. I have yet to activate it and will be doing so this Saturday Feb 4th, 2006. On the visa in my passport, it states that the IV Expires 29JUL2006. Our 2nd wedding anniversary is on October 7th, 2006. I was just wondering when do I send in the I751 Lifting Conditions Application? What happens at the POE, do they extend the visa or am I just misunderstanding something.

Any help would be appreciated.

6-March-2006 Recieved PR(green card) Card in mail.

Kevin you have to come into the USA before the July 29th date to activate the visa. Once you come into the USA you need to lift conditions 21 months later. You will submit the paperwork then and interview for your 10 yr green card. At POE you may breeze thru or have some type of interview. Coming here on CR1 if you asked for your social security card it will tell the ss administration at POE you entered the country and you should receive the card within 3 weeks. If you do not then you must go to a local office and apply for your card at that time. Good luck and hope I explained this process.

Kevin,

You are misunderstanding something. Your visa will not be extended when you enter the USA - it will become moot because you will become an LPR on enty, no visa required any longer. The visa, or the page opposite it, will be annotated to indicate that you have become an LPR.

How Do I Remove the Conditions on Permanent Residence Based on Marriage?

A lawful permanent resident is given the privilege of living and working in the United States permanently. Your permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day you were given permanent residence. You are given conditional resident status on the day you are lawfully admitted to the United States on an immigrant visa or receive adjustment of status. Your permanent resident status is conditional, because you must prove that you did not get married to evade the immigration laws of the United States.

You and your spouse must apply together to remove the conditions on your residence. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your alien registration card (commonly know as green card) is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country.
