EAD Expedite success for non-profit criteria? (merged)

Hi all, 

 

I am currently trying to prepare documents so I can expedite my EAD based on 2 criterias - 1) financial loss to myself and my employer; AND 2) Nonprofit organization (as designated by the Internal Revenue Service) whose request is in furtherance of the cultural or social interests of the United States. 

 

Has anybody had experience with this? What are some documents that will help? Please advise.

Severe financial loss, so you would need to be able to document that. Financial records.

I have financial records for that --- my husband is also chronically ill. 

I am in the education field working with school districts.

Is your AOS case marriage based?

 

If you are already working for them, do you already have work authorization? If so, why would that authorization end? If your work authorization ended, when did it end or when will it end?  If you had work authorization that had a scheduled end date, then USCIS could go with the opinion that that is what you and your employer signed up for, it was not an unexpected event. 

 

If you are currently working without authorization not sure you want to highlight that with an expedite request. 

 

If you were on F1 OPT, a J1 or other non-immigrate visa that ran out or is running out then I guess you can go ahead and request an expedite for the EAD. But pointing out a desperate need for a work authorization and ultimately the desperate need for the green card may undermine your case of getting a green card for a good faith marriage.

 

You should consider carefully what you submit, it may have the opposite effect as you intend in your case. Also, a number EADs are coming much more quickly in recently filed AOS cases. You may get an EAD in a couple of months with a strong AOS application.

Hi all,

Applied for AOS through marriage. PD - Dec 7, 2022. I expedited EAD on Jan 10, 2023 and denied 14 days later. During this time, I had also reached out to my congressman with my documents to help with the expedite.

I received no communication from them until today when they said they spoke to USICS officer and the supervisor will be looking at my case in the next 30 days AND MAY approve the expedite. No promises.Has this happened to folks? What’s usually been the result? Should I get my hopes up or keep my head down and keep waiting it out?

Why do you think you should get an expedite?  AOS is rarely, if ever, expedited.

 

EAD/AP is more likely to be expedited with supporting documentation (i.e written job offer, documented family emergency overseas etc).

It is an EAD expedite based on financial loss to myself and my employer.

Ah, sorry, I misread and thought you were requesting an expedite for the green card itself.

No problem! 

I provided more than 40 pages of evidence including a letter from my employer, bills, rent due, and my U.S citizen's chronic condition that has a severe impact on our finances etc. I also provided a cover letter explaining our situation but my own expedite was denied. I am concerned that since the congressman's office has all the SAME documents, this will lead to a denial as well.. any suggestions?

Well that is odd, it sounds like a very well prepared request.  The only thing I can think of is to try the same with your US senator's office, as well as the USCIS ombudsman.  

 

What visa are you adjusting from?

 

One think that sticks out is the conundrum of expediting for financial reasons, but needing to be sponsored by the USC.  Do you have a joint sponsor?

I am adjusting from F-1 and my OPT expired a couple of weeks ago. 

My USC is able to sponsor me since he earns more than the minimum (I also added my own income and assets). Additionally, my income is higher than his which aids our expenses. I might have gotten the first denial because of the same...I am not sure.

 

I'm worried I am going to be stuck for the next year because of these mistakes maybe.

Agreed.

There seems to be conflicting statements @zindagi123

 

One one hand your husband provided affidavit of support. The purpose of this document is to demonstrate to the government that he can sponsor, e.g. support you financially. On the other hand, you're asking for expedite, based on financial grounds. I wouldn't be surprised if you will be asked for joint sponsor, since your husband cannot support you financially.
