China-US relations

Hello, my husband and I applied for CR1 visa in February 24, 2022, we are currently still waiting. Before all this, I used to be a student in China but ever since Covid hit I managed to go back to my country. Now my University is demanding that I go back to finish my degree ( for around 6 months max ). I was wondering, if me going back to China would delay or cause any issues in the future. Because of the special relationship both countries have, I find myself in a rather risky situation. Anybody has any idea what to do?

P.s: my husband is in the US army

I gather you’re the beneficiary. University can demand but they can’t force you to come back. Is that something you want to do?

2. What stage of the spouse visa process are you in?

3. Are there no other options for completing your degree? 

4. Why do you think going to school in China would be an issue for your immigration?  Is it a concern for timing or something else?

First, it seems you have not applied for anything yet.  The US Citizen petitioner filed a petition in behalf of their foreign spouse.  When that petition is approved, the foreign spouse is invited to "apply for a visa".  That said, your post lacks detail.  It seems you are NOT CHINESE, but even that is not clear.  The only problem I see, would be related to travel between China and the USA. You might get caught in a situation where you cannot travel to the USA from China.  Sounds like you have some choices to make.  

 

On what basis is the University making its "demand"?  Is it really a demand? Do they even have standing to make such a demand?  Please clarify.

Correct, I am the beneficiary. The University is asking students to go back as it will be fully implementing offline classes starting March. Not going back can lead to the suspension of the degree. 

I can't say that I do not want to go back, as I still have a lot of unfinished business in China to deal with.

2. I am in the USCIS stage at 12 months, still waiting as of today.

3. Unfortunately no, failure to return leads to the suspension of the degree.

4. My concern is not for the timing, it's more for the process part. Wouldn't it be a problem if I traveled to China and then the United States? Will I have to show proof of my stay in China regardless of it being less than 6 months?

I don’t see what the problem would be if you traveled from China to the US or if you had an interview at a US consulate in China. What problems or issues do you think you might have? 

 

You will need a police certificate from Morocco for the interview in China (if you choose to finish your degree and have your interview there).

As I have mentioned before, we have applied for the CR1 I-130 and an additional K3mand have been waiting for 12 months, it's still being processed as we speak. I am not Chinese, I am from an African country, Morocco. And you are correct, my issue is the traveling portion of the whole thing, from China to the US.

Most universities in China are actively calling all the students abroad to go back on-site, and take offline classes to get their degrees. And I quote " Those whole fail to return to school before August 31st, will no longer retain their academic status", and also " Students who have special reasons for not being able to enter China and return to school in time, are advised to apply for a study suspension". Losing my degree is not an option for me.

3.  Not a problem unless travel between China and USA becomes restricted as it was recently.  Impossible to predict, but you can also interview in China if you are there as a student.

 

4.  No police report for a stay of less than six months.

To be CLEAR.  Nobody has "applied for" anything yet.  The I-130 is a petition for alien relative.  You might get a CR1 visa or you might get an IR1, but you will only "apply" by submitting a DS260 and appearing for a visa interview.

Thank you for the clarification. I didn't know. I just regarded the procedure as an application.

Google "reciprocity by country" select the country and scroll down to police report.

Every applicant submits police certificates.

Click the menu on top right corner, select immigration timelines, CR1/IR1 and filter the results for China.
