AOS Form I-864 Proof of Income Questions

Hoping that you're doing well. Can you please help me with some doubts that I have regarding Form I-864 ?

I am a LPR who entered the country end of December 2019. I have filled and paid taxes for the years 2020, 2021.

2020 filed single because I was not married.

2021 filed single because I was not married.

Got married in July 2021, petitioned for my wife on September 2021

I-130 approved in Feb 2023, NVC  sent welcome email Feb 2023.

 

2022 taxes filed married filling jointly by applying for ITIN for my spouse using Form W7.

And this usually takes longer, usually 7 weeks as per the IRS, that's almost 2 months.

I filed the 2022 taxes on 31 Jan 2023, so I'm guessing the processing will be done by end of March.

 

I can currently provide the tax return transcripts for 2020, 2021, and pay stubs and a proof of employment document. 

My question is, should I wait for this tax return to be process before I submit the AOS ?

 

Another doubt I have is, I thought tax return transcripts were better than income tax returns, because they encompass everything and with tax return transcripts you don't need to add accompanying W2 or 1099.

 

But the instruction for Form I-864 says 

 

 

That is confusing me, should I submit Tax Return Transcripts or simple Tax Returns ??

You can submit the transcripts for the previous years you can print them from the ira website. Also if you times your taxes they gave you a copy you submit those. Transcript for this year might already be uploaded too.

I filed my taxes on 2/7 and a week later the transcript was already there. I submitted that and a letter from the employer and my documents wer DQed. Take into consideration that there’s a size limit when submitting docs To NVC transcrips are smaller in size and have all the information they need. Hope this helps

Do you think that I should wait for my spouse ITIN which might come end of March, then amend the 2021 return before I submit the Affidavit of Support and other documents to NVC ?

Current processing times for NVC is like 19 days after document submissions. I'm thinking I apply now with what I got, then if they dont DQ our case because of the 2021 Single filling, I then amend and resubmit ? 

I'm thinking of taking a chance and doing that, instead of just wasting a month waiting for my spouse ITIN to be ready...

Submit your I-864 with the returns you actually filed.  "Single" may be wrong for 2021 and you should probably amend it and fix it with the IRS, but it's not going to affect whether your I-864 is approved or denied.

  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

You can always include a letter that you realized a mistake and is working to amend the tax return to make correction. That'll give them less time to worry about.

 

I agree with @beloved_dingo his comment is on point.

NOA as of 4/29/24 - Oath Ceremony scheduled for May 30th in Chattanooga, TN. Rescheduled as of May 2nd, 2024 by USCIS - new date is May 29th.
May 29th - Naturalized! Ta-da!

I would submit what you have. Start fixing with the IRS and update the documents when they are ready for your Interview. They will ask you to update whatever documents are out of date.
