Question about Filing as a U.S. tax resident during CR1 process (split)

Hi my husband is US citizen and I am a non resident currently living in India. We recently submitted our documents in NVC and expecting DQed by mid march 2023 and then interview at Mumbai consulate by 0ct-nov 2023. My husband is considering filing his taxes 2022 as single until I enter USA and get my SSN. Would his decision really harm our immigration process in any ways?

I don't think filing as single when married is an option. This might be illegal.

He cannot legally file as single.  He can file Married- Filing Separately or he can file as Head Of Household if he qualifies.  This is an IRS issue, not an immigration issue.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
